AN ACT to amend the alcoholic beverage control law, in relation to an
exemption for certain property from the prohibition of alcohol sales
within a certain distance of a church
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subdivision 7 of section 64 of the alcoholic beverage
2 control law is amended by adding a new paragraph (e-16) to read as
3 follows:
4 (e-16) Notwithstanding the provisions of paragraph (a) of this subdi-
5 vision, the authority may issue a retail license for on-premises
6 consumption for a premises which shall be located within two hundred
7 feet of a building occupied as a church, synagogue or other place of
8 worship, provided such premises constitute a premises for the sale of
9 food or beverages at retail for consumption on the premises located
10 wholly within the boundaries of the county of Washington, bounded and
11 described as follows:
12 ALL THAT CERTAIN PIECE OR PARCEL OF LAND situate, lying and being in
13 the Village of Hudson Falls, County of Washington and the State of New
14 York, more particularly bounded and described as follows:
15 BEGINNING at a point in the westerly line of Main Street at the
16 northeasterly corner of the lands conveyed to C. Bruce Wetmore and Gary
17 C. Wilson by deed dated August 12, 1988 and recorded in Book 580 of
18 deeds at page 289; thence running South 75 degrees, 21 minutes and 12
19 seconds West to and along and beyond the face of the two story brick
20 building on the premises described herein being also the northerly
21 bounds of the lands of said Wetmore and Wilson, a distance of 77.00 feet
22 to the northwesterly corner of said lands of Wetmore and Wilson; thence
23 running North 14 degrees, 28 minutes and 43 seconds West, a distance of
24 28.22 feet along the lands now or formerly of Erskine Rogers, Jr., to
25 the southerly bounds of the lands of Drake Brothers, Inc.; thence
26 running North 75 degrees, 21 minutes and 47 seconds East along said
27 lands to and along and beyond the face of the two story brick building

1 on the premises herein described, a distance of 77.00 feet to the
2 westerly bounds of said Main Street; thence running South 14 degrees, 28
3 minutes and 43 seconds East, a distance of 28.20 feet to the point and
4 place of beginning.
5 Bearings given in the above description refer to the magnetic meridian
6 as of November, 1970.
7 § 2. This act shall take effect immediately.
