AN ACT to authorize the commissioner of the office of general services
to convey certain unappropriated state land to KIPP: Albany Community
Public Charter Schools; and providing for the repeal of such
provisions upon expiration thereof
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subject to the provisions of this act but notwithstanding
2 any other provision of law to the contrary, the commissioner of general
3 services is hereby authorized to transfer and convey to KIPP: Albany
4 Community Public Charter Schools, in consideration of one dollar and
5 upon such other conditions as the commissioner may deem proper, the
6 state land located at 596 Manning Boulevard, Albany, New York, in the
7 county of Albany.
8 § 2. The lands authorized by section one of this act to be transferred
9 and conveyed are as follows:
10 ALL that piece or parcel of land, situate, lying and being in the City
11 of Albany, County of Albany, State of New York, more particularly bound-
12 ed and described as follows:
13 BEGINNING at a point in the north line of Manning Boulevard North
14 (a/k/a Manning Boulevard); said point being 400 feet distant in a
15 westerly direction from the intersection of the north line of Manning
16 Boulevard North (a/k/a Manning Boulevard) and the west line of Northern
17 Boulevard; thence northerly at right angles to the north line of Manning
18 Boulevard North (a/k/a Manning Boulevard) a distance of 199.31 feet;
19 thence westerly, parallel with the north line of Manning Boulevard North
20 (a/k/a Manning Boulevard) and along the north line of the lands conveyed
21 to Louis J. Valente by New York Central Railroad by deed recorded in the
22 office of the Clerk of Albany County in Book 1688 of Deeds at Page 25 a
23 distance of 217.95 feet; thence southerly making an interior angle of
24 58° 04' with the last described course and along the west line of said

1 lands a distance of 234.89 feet to the north line of Manning Boulevard
2 North (a/k/a Manning Boulevard) a distance of 93.73 feet to the point or
3 place of beginning.
4 § 3. The description in section two of this act of the land to be
5 conveyed is not intended to be a legal description but is intended to
6 identify the parcel to be conveyed. As a condition of the transfer,
7 KIPP: Albany Community Public Charter Schools shall submit to the
8 commissioner of general services, for his or her approval: (i) an accu-
9 rate survey and description of the lands to be conveyed, which may be
10 used in the conveyance thereof; and (ii) a site plan showing the
11 improvements necessary to carry out the public purposes set forth in
12 section five of this act.
13 § 4. The office of general services shall not transfer or convey the
14 land described in section two of this act unless application is made to
15 the office of general services by KIPP: Albany Community Public Charter
16 Schools, such application shall be made within two years after the
17 effective date of this act. The transfer or conveyance of such land
18 shall be made within one year after KIPP: Albany Community Public Char-
19 ter Schools submits the application to the office of general services.
20 § 5. Any lands transferred pursuant to this act shall be used and
21 improved solely for educational and public benefit, including but not
22 limited to, the purposes of improving traffic flow at an appurtenant
23 public school facility for the benefit of the school and the neighbor-
24 hood and to provide adequate public parking and trail access in support
25 of the adjacent Tivoli Lake Preserve owned by the city of Albany, and
26 upon termination of such use, title to the lands so transferred shall
27 revert to the state of New York.
28 § 6. This act shall take effect immediately and shall expire and be
29 deemed repealed 3 years after such date.
