Directs the department of health to establish and administer a program for the certification, operation, and oversight of two prescribed pediatric extended care centers to provide supportive services to medically stable and medically complex children who require continual care.

AN ACT to amend the public health law, in relation to establishing
prescribed pediatric extended care centers; and providing for the
repeal of such provisions upon expiration thereof
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The public health law is amended by adding a new article
2 44-A, to read as follows:

9 § 4450. Legislative intent. The legislature hereby finds that
10 medically fragile children, as defined in section four thousand four
11 hundred one of this chapter, often require continual skilled nursing and
12 therapeutic care which cannot be adequately provided in home or school
13 settings alone. It is therefore the intent of the legislature to author-
14 ize and regulate prescribed pediatric extended care centers that provide
15 coordinated, comprehensive, nonresidential supportive services to such
16 children and their families under the supervision of the department.
17 § 4451. Establishment and authorization. 1. The department is hereby
18 authorized and directed to establish and administer a program for the
19 certification, operation, and oversight of prescribed pediatric extended
20 care centers.
21 2. The commissioner may approve up to two centers for operation within
22 the state, at least one of which shall be located within one of the five
23 boroughs of the city of New York.
24 3. A prescribed pediatric extended care center shall be a nonresiden-
25 tial facility that provides supportive services to medically stable and
26 medically complex children who require continual nursing care.
27 4. Each such center shall provide, at a minimum:

1 (a) medical and skilled nursing services including, but not limited
2 to, ventilator and tracheostomy management, suctioning, oxygen therapy,
3 nebulizer treatments, enteral feeding and tube care, apnea monitoring,
4 central-line and port care, ostomy management, medication adminis-
5 tration, bladder catheterization and irrigation, shunt monitoring,
6 seizure assessment and management, skilled assessment, and emergency
7 protocols;
8 (b) early-intervention and developmental therapies, including physical
9 therapy, speech therapy, and occupational therapy; and
10 (c) psychosocial, nutritional, and other supportive services as the
11 department may require.
12 § 4452. Regulatory authority. 1. The commissioner shall promulgate
13 rules and regulations necessary to effectuate the provisions of this
14 article. Such regulations shall include, but not be limited to, stand-
15 ards for:
16 (a) the establishment, certification, and renewal of prescribed pedia-
17 tric extended care centers;
18 (b) minimum staffing qualifications and ratios;
19 (c) health, safety, and infection-control requirements;
20 (d) clinical documentation, quality-assurance, and reporting obli-
21 gations; and
22 (e) inspection, enforcement, and penalty procedures consistent with
23 sections twelve and twelve-b of this chapter.
24 2. The department shall have all powers necessary to implement and
25 enforce this article, including the authority to issue guidance, enter
26 into contracts, collect data, and take such actions as may be necessary
27 to protect the health and safety of children served by such centers.
28 § 4453. Reporting. The commissioner shall report to the governor, the
29 speaker of the assembly, and the temporary president of the senate on or
30 before September thirtieth, two thousand thirty, on the clinical and
31 cost-effectiveness of the program and any legislative or regulatory
32 recommendations.
33 § 2. This act shall take effect immediately and shall expire and be
34 deemed repealed March 31, 2031.
