        AN ACT  establishing  the  adult  care  facility  voucher  demonstration
          program;  and providing for the repeal of such provisions upon expira-
          tion thereof
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1. 1. Notwithstanding any other provision of law, the depart-
     2  ment of health shall establish and implement, the  adult  care  facility
     3  voucher  demonstration  program  for  persons with dementia, Alzheimer's
     4  diagnosis, or other cognitive impairments.
     5    2. In at least three counties, representing urban, suburban and  rural
     6  settings,  such  program shall provide a sliding-scale subsidy for adult
     7  care facility residents who are at risk of losing nursing home care  due
     8  to  depleted resources and to individuals who are not eligible for Medi-
     9  caid or supplemental security income, but in  need  of  adult  day  care
    10  services.
    11    3.  Such program shall examine whether such subsidy pursuant to subdi-
    12  vision two of this section can reduce or delay the need for nursing home
    13  care by assisting seniors to remain living within their community or  in
    14  their  assisted living residence or adult care facility while generating
    15  a Medicaid savings.
    16    4. An assessment of the possible creation of a  similar  demonstration
    17  for individuals who are at risk for Medicaid-funding nursing home place-
    18  ment,  but  would  benefit  from  partially  subsidized  adult  day care
    19  services.
    20    § 2. This act shall take effect immediately and shall  expire  and  be
    21  deemed repealed three years after the effective date of this act.
