AN ACT in relation to the alienation of certain parklands by the Village
of Southampton in the Town of Southampton in the County of Suffolk
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subject to the provisions of this act, the village of
2 Southampton, located in the town of Southampton, county of Suffolk,
3 acting by and through its governing body and upon such terms and condi-
4 tions as determined by such body, is hereby authorized to discontinue as
5 parklands and alienate the lands described in section three of this act
6 for the purpose of constructing a new wastewater treatment facility.
7 § 2. The authorization provided for in section one of this act shall
8 be effective only upon the condition that the village of Southampton
9 dedicates the lands described in section four of this act as parkland,
10 provided that such lands have never been used for public open space or
11 municipal park purposes.
12 § 3. The parklands authorized by section one of this act to be discon-
13 tinued are described as follows:
14 ALL that certain piece or parcel of land situate in the Village and Town
15 of Southampton, County of Suffolk, State of New York, more particularly
16 bounded and described as follows: BEGINNING at a point formed by the
17 intersection of the westerly line of Windmill Lane and the southerly
18 line of lands now or formerly of Augustus Marshall Estate, said point
19 being situate South 5° 09' 00" West 303.92 feet from a granite monument
20 set at the intersection of the westerly line of Windmill Lane and the
21 southerly line of White Street and running thence from the point of
22 beginning southerly along the westerly line of Windmill Lane South 5°
23 09' 00" West 184.22 feet to lands now or formerly of Mrs. Gilbert White;
24 thence westerly along lands now or formerly of Mrs. Gilbert White North
25 83° 08' 30" West 582.55 feet to a monument; thence northerly along lands
26 now or formerly of Mrs. Gilbert White North 0° 43' 10" West 182.11 feet
27 to a monument and lands now or formerly of Frank Postwaitowski; thence
28 easterly along lands now or formerly of Frank Postwaitowski; lands now

1 or formerly of Annie Benett and lands now or formerly of Augustus Mars-
2 hall Estate, and passing through a monument South 83° 29' 10" East
3 601.09 feet to the point or place of beginning; containing 2.478 acres
4 of land.
5 § 4. Prior to the discontinuance and alienation of the parklands
6 described in section three of this act, the village of Southampton shall
7 dedicate as parkland the land described as follows:
8 All that certain plot, piece, or parcel of land, situate, lying and
9 being in the Village of Southampton, Town of Southampton, County of
10 Suffolk, and State of New York, being bounded and described as follows:
11 BEGINNING at a point on the westerly side of Windmill Lane (S.R. 27A)
12 the following two (2) courses and distances from the extreme northerly
13 end of the arc of a curve connecting the westerly side of Windmill Lane
14 (S.R. 27A) and the northerly side of Coopers Farm Road:
15 1. North 05 degrees 42 minutes 28 seconds East 292.81 feet;
16 2. North 07 degrees 25 minutes 28 seconds West 251.40 feet;
17 RUNNING THENCE South 82 degrees 58 minutes 17 seconds West 192. 71
18 feet;
19 THENCE South 10 degrees 41 minutes 57 seconds East 84.87 feet;
20 THENCE South 79 degrees 18 minutes 03 seconds West 80.00 feet;
21 THENCE North 10 degrees 41 minutes 57 seconds West 237.68 feet;
22 THENCE South 85 degrees 02 minutes 06 seconds East 281.57 feet to the
23 westerly side of Windmill Lane (S.R. 27A);
24 THENCE along the westerly side of Windmill Lane (S.R. 27 A), South 07
25 degrees 25 minutes 28 seconds East 137.24 feet to the point or place of
26 BEGINNING; containing 1.10 acres of land.
27 § 5. In the event that the fair market value of the parklands
28 described in section four of this act to be dedicated by the village of
29 Southampton pursuant to this act are not equal to or greater than the
30 fair market value of the parklands to be discontinued as described in
31 section three of this act, the village of Southampton shall dedicate the
32 difference of the fair market value of the lands to be discontinued and
33 the lands to be dedicated for the acquisition of additional parklands
34 and/or capital improvements to existing park and recreational facili-
35 ties.
36 § 6. In the event that the village of Southampton received any funding
37 support or assistance from the federal government for the purchase,
38 maintenance or improvement of the parklands set forth in section three
39 of this act, the discontinuance and alienation of such parkland author-
40 ized by the provisions of this act shall not occur until the village of
41 Southampton has complied with any federal requirements pertaining to the
42 alienation or conversion of parklands, including satisfying the secre-
43 tary of the interior that the alienation or conversion complies with all
44 conditions which the secretary of the interior deems necessary to assure
45 the substitution of other lands shall be equivalent in fair market value
46 and usefulness to the lands being alienated or converted.
47 § 7. This act shall take effect immediately.
