AN ACT to authorize the city of New York to discontinue a portion of
real property in the county of the Bronx as parkland and to grant
easements for improvements to the railroad right-of-way to bring
Metro-North railroad service to four new stations in the Bronx and to
Pennsylvania Station in the county of New York
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subject to the provisions of this act, but notwithstanding
2 any provision of law to the contrary, the city of New York is hereby
3 authorized to discontinue the use as parklands of the lands described in
4 section three of this act and to grant easements to the metropolitan
5 transportation authority, upon such terms and conditions as the city
6 shall determine, to enable the metropolitan transportation authority and
7 Metro-North commuter railroad company, an affiliate of the metropolitan
8 transportation authority, to construct improvements and gain ingress and
9 egress to and from railroad equipment, stations and right-of-way on such
10 former parkland, and to construct below surface and surface utility
11 infrastructure, in order to bring Metro-North commuter railroad company
12 service to four new stations in the Bronx and to Pennsylvania Station in
13 the county of New York.
14 § 2. The authorization provided in section one of this act shall be
15 effective only upon the condition that the city of New York dedicates an
16 amount equal to or greater than the fair market of the parklands being
17 discontinued towards the acquisition of new parklands and/or capital
18 improvements to existing parklands and recreational facilities within
19 the borough of the Bronx.
20 § 3. The lands hereby authorized to be discontinued as parklands and
21 for which easements may be granted to the metropolitan transportation
22 authority are located in the county of the Bronx, city and state of New
23 York, and are bounded and described as follows:

55 § 4. In the event that the city of New York received any funding,
56 support or assistance from the federal government for the purchase,

1 maintenance or improvement of the parklands set forth in section three
2 of this act, the discontinuance and alienation of such parkland author-
3 ized by the provisions of this act shall not occur until the city of New
4 York has complied with any federal requirements pertaining to the alien-
5 ation or conversion of such parklands, including satisfying the secre-
6 tary of the interior that the alienation or conversion complies with all
7 conditions which the secretary of the interior deems necessary to assure
8 the substitution of other lands shall be equivalent in fair market
9 value and usefulness to the lands being alienated or converted.
10 § 5. After completion of improvements to the former parkland discon-
11 tinued and alienated by the city of New York pursuant to this act, the
12 metropolitan transportation authority may, in its discretion, assign or
13 otherwise transfer some or all of the easements granted pursuant to this
14 act to the National Railroad Passenger Corporation or the successor
15 thereto, subject to retention of such rights and obligations of the
16 metropolitan transportation authority on behalf of Metro-North
17 commuter railroad company as the metropolitan transportation authority
18 may deem appropriate.
19 § 6. Upon the completion of construction, the metropolitan transporta-
20 tion authority shall, in agreement with the city of New York and in
21 consultation with the local community board, restore the surface of the
22 lands described in section three of this act and such lands shall
23 continue to be used for park purposes.
24 § 7. This act shall take effect immediately.
