Creates a publicly accessible database for contracts made between U.S. immigration and customs enforcement and private entities conducting business in the state of New York; requires entities to provide the department of state with a copy of contracts made between U.S. immigration and customs enforcement and private entities operating in the state of New York.

AN ACT to amend the executive law, in relation to creating a publicly
accessible database for contracts entered into by U.S. immigration and
customs enforcement and private entities
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The executive law is amended by adding a new section 94-c
2 to read as follows:
3 § 94-c. Database for contracts with federal immigration enforcement.
4 1. For the purposes of this section, the term "entity" shall mean any
5 person, business, or other legal entity that operates or conducts busi-
6 ness in the state of New York.
7 2. Any entity that enters into a contract or other agreement with U.S.
8 immigration and customs enforcement beginning on or after January first,
9 two thousand twenty-five, for purposes including but not limited to, the
10 leasing or operation of immigration detention facilities, office facili-
11 ties, parking facilities or other related services, shall file a copy of
12 such contract or other agreement with the department of state. Any such
13 contract or other agreement entered into on or after January first, two
14 thousand twenty-five and prior to the effective date of this section
15 shall be filed with the department of state within ninety days of such
16 effective date.
17 3. The department of state shall maintain and publish a publicly
18 accessible database of contracts or other agreements filed with the
19 department of state pursuant to subdivision two of this section, which
20 shall include but not be limited to:
21 (a) the name of the entity;
22 (b) the location of the entity receiving the contract and the primary
23 location of performance under the contract;
24 (c) information on the nature of the contract; and
25 (d) any other relevant information specified by the department of
26 state.
27 § 2. This act shall take effect immediately.
