AN ACT to amend the criminal procedure law, in relation to granting
peace officer status to security officers employed by Albany Memorial
Hospital, Samaritan Hospital, and St. Peter's Hospital
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 2.10 of the criminal procedure law is amended by
2 adding a new subdivision 88 to read as follows:
3 88. Security officers employed by Albany Memorial Hospital, located at
4 600 Northern Boulevard in the city of Albany; Samaritan Hospital,
5 located at 2215 Burdett Avenue in the city of Troy; and St. Peter's
6 Hospital, located at 315 South Manning Boulevard in the city of Albany,
7 when acting pursuant to their special duties on the grounds or premises
8 owned, controlled or administered by such hospital or any of its subsid-
9 iaries, or on any public street or sidewalk that abuts the property of
10 such hospital, shall have the powers of peace officers within such
11 geographic area and beyond such area upon the request of the chief law
12 enforcement officer of the local law enforcement jurisdiction or such
13 officer's designee for the purpose of transporting an individual who has
14 been arrested in accordance with section 140.27 of this chapter when no
15 local law enforcement officer is available to transport such individual
16 in a timely manner. Such peace officers shall have the powers set forth
17 in paragraphs (a), (b), (c), (d), (e) and (h) of subdivision one of
18 section 2.20 of this article and the power to detain an individual for a
19 reasonable period of time while awaiting the arrival of law enforcement,
20 provided that such peace officer has actual knowledge, or probable cause
21 to believe, that such individual has committed an offense; provided,
22 however, that nothing in this subdivision shall be deemed to authorize
23 such officer to carry, possess, repair or dispose of a firearm unless
24 the appropriate license therefor has been issued pursuant to section
25 400.00 of the penal law.
26 § 2. This act shall take effect immediately.
