AN ACT to amend the alcoholic beverage control law, in relation to
requiring retail licensees for on-premises alcohol consumption provide
tap water upon request
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 106 of the alcoholic beverage control law is
2 amended by adding a new subdivision 18 to read as follows:
3 18. All retail licensees for on-premises consumption, except corpo-
4 rations operating a vessel, railroad car, or aircraft being operated on
5 regularly scheduled flights by a United States certificated airline,
6 shall serve tap water to a patron, upon request, at no cost to such
7 patron. Such water shall meet all federal and state requirements
8 concerning purity of drinking water and shall be supplied in a recepta-
9 cle of not less than eight ounces per serving.
10 § 2. This act shall take effect on the thirtieth day after it shall
11 have become a law.
