AN ACT to amend the public health law, in relation to requiring safety
net hospitals to submit an annual plan for increasing revenue
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 2807 of the public health law is amended by adding
2 a new subdivision 22 to read as follows:
3 22. (a) Any hospital designated by the department as a safety net
4 hospital shall submit an annual plan to the department outlining
5 proposed policies and actions to generate or increase revenue, and shall
6 submit follow up reports annually to document progress towards estab-
7 lished goals. Such policies and actions may include, but are not limited
8 to, programs to attract more patients with private insurance, methods of
9 retaining patients who go from Medicaid to private insurance, offering
10 profitable procedures, enrolling eligible patients in Medicaid, collect-
11 ing payments from patients who can afford to pay, and developing underu-
12 tilized land in the hospital's possession.
13 (b) For purposes of this subdivision, a "safety net hospital" shall
14 mean:
15 (i) a public hospital, critical access hospital or sole community
16 hospital; or
17 (ii) (A) at least thirty-five percent of all patient volume in their
18 outpatient lines of business are Medicaid, uninsured and dual eligible
19 individuals, or (B) at least thirty percent of inpatient treatment are
20 Medicaid, uninsured and dual eligible individuals; or
21 (iii) serving at least thirty percent of all Medicaid, uninsured and
22 dual eligible members in a county or multi-county community.
23 § 2. This act shall take effect on the ninetieth day after it shall
24 have become a law.
