        AN ACT to amend the general  business  law,  in  relation  to  exempting
          payroll  agencies  from  the  definition  of  hiring party for certain
          purposes
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1. Subdivision 4 of section 1410 of the general business law,
     2  as added by chapter 98 of the laws  of  2024,  is  amended  to  read  as
     3  follows:
     4    4.  (a) "Hiring party" means any person who retains a freelance worker
     5  to provide any service, other than:
     6    [(a)] (i) the United States government;
     7    [(b)] (ii) the state of New York, including  any  office,  department,
     8  agency,  authority  or other body of the state including the legislature
     9  and the judiciary;
    10    [(c)] (iii) a municipality, including any office,  department,  agency
    11  or other body of a municipality; or
    12    [(d)] (iv) any foreign government.
    13    (b) For the purpose of this article, the term "hiring party" shall not
    14  include  a  payroll  agency  that provides payroll services on behalf of
    15  another person or organization.
    16    § 2. This act shall take effect on the  same  date  and  in  the  same
    17  manner  as  chapter 98 of the laws of 2024 amending the general business
    18  law relating to contracted compensation payments, takes effect.
