        AN  ACT  to amend the penal law, in relation to establishing the offense
          of obstructing a police officer or peace officer
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1. The penal law is amended by adding a new section 195.09 to
     2  read as follows:
     3  § 195.09 Obstructing a police officer or peace officer.
     4    A person is guilty of obstructing a police officer  or  peace  officer
     5  when such person intentionally interferes with, inhibits, or attempts to
     6  interfere  with  or  inhibit  a  police  officer or a peace officer from
     7  performing their lawful  duties.  For  the  purposes  of  this  section,
     8  "interferes  with,  inhibits, or attempts to interfere with or inhibit a
     9  police officer or peace officer from  performing  their  lawful  duties"
    10  includes,  but  is  not  limited  to: (i) spitting, throwing or spilling
    11  items, including snow, ice, or other substances, liquid or otherwise, at
    12  or on such officer;  and  (ii)  pushing,  shoving,  kicking,  physically
    13  impeding or otherwise subjecting such officer to physical contact.
    14    Obstructing a police officer or peace officer is a class E felony.
    15    §  2.  This  act shall take effect on the thirtieth day after it shall
    16  have become a law.
