        Introduced  by  M. of A. CRUZ -- read once and referred to the Committee
          on Judiciary
 
        AN ACT to amend the surrogate's court procedure act, in relation to  the
          eligibility of a person who is not a lawful permanent resident to be a
          fiduciary
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Section 707 of  the  surrogate's  court  procedure  act  is
     2  amended by adding a new subdivision 3 to read as follows:
     3    3.  A person who is not a lawful permanent resident shall not be auto-
     4  matically disqualified to be a fiduciary.
     5    § 2. This act shall take effect immediately.
