CASHMAN -- read once and referred to the Commit- tee on Correction AN ACT to amend the correction law, in relation to residential rehabili- tation units in correctional facilities The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The correction law is amended by adding a new section 608 2 to read as follows: 3 § 608. Prohibition of two-person cells in certain housing situations. 4 1. For purposes of this section, "two-person cells" shall mean cells 5 utilized by the department to house two incarcerated individuals in 6 residential rehabilitation units at the same time. 7 2. The department shall be prohibited from utilizing two-person cells 8 in any residential rehabilitation unit, unless an incarcerated individ- 9 ual subject to a residential rehabilitation unit cell provides express 10 agreement to reside in such a unit with another incarcerated individual. 11 Any incarcerated individual residing in a two-person cell in a residen- 12 tial rehabilitation unit at the time this section takes effect who does 13 not provide such express agreement, shall be immediately relocated to a 14 single cell environment within the residential rehabilitation unit. 15 3. The department shall be authorized to promulgate or repeal any 16 rules or regulations necessary to facilitate the implementation of the 17 provisions of this section. 18 § 2.
