        Introduced  by  COMMITTEE  ON RULES -- (at request of M. of A. McDonald,
          E. Brown) -- read once and referred to the Committee on Health
 
        AN ACT to amend the public health law, in relation to  the  offices  and
          departments  that  the department of health shall consult with for the
          traumatic brain injury program  and  to  the  designation  of  certain
          persons  or  their  designees  to  the traumatic brain injury services
          coordinating council
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1. Section 2740 of the public health law, as amended by chap-
     2  ter 672 of the laws of 2019, is amended to read as follows:
     3    § 2740. Traumatic brain injury program. The department shall have  the
     4  central  responsibility for administering the provisions of this article
     5  and otherwise coordinating the state's policies with respect to traumat-
     6  ic brain injury, in consultation with the office for people with  devel-
     7  opmental  disabilities,  the  office of mental health, the department of
     8  education, the office  of  [alcoholism  and  substance  abuse  services]
     9  addiction  services and supports, the department of social services, the
    10  office for the prevention of domestic violence, the department of veter-
    11  ans' services, the office of the  advocate  for  the  disabled  and  the
    12  commission on quality of care for the mentally disabled.
    13    §  2.  Subdivision  1  of  section  2744  of the public health law, as
    14  amended by chapter 672 of the laws  of  2019,  is  amended  to  read  as
    15  follows:
    16    1.  The traumatic brain injury services coordinating council is hereby
    17  established and shall consist of the following persons or  their  desig-
    18  nees:  the  commissioner, the commissioner of the office for people with
    19  developmental disabilities, the office of mental health, the commission-
    20  er of education, the commissioner of  [alcoholism  and  substance  abuse
    21  services]  addiction  services  and supports, the commissioner of social
    22  services, the state advocate for the disabled, the executive director of
    23  the office for the prevention of domestic violence, the commissioner  of
    24  the  department  of veterans' services, and the commission on quality of
    25  care for the mentally disabled. In addition, the council  shall  consist

     1  of  the following persons: five persons appointed by the governor, three
     2  of whom shall be persons with traumatic brain injury  and  two  of  whom
     3  shall  be representative of the public and have a demonstrated expertise
     4  and  interest  in  traumatic  brain injury; two persons appointed by the
     5  temporary president of the senate, one of whom shall be  a  person  with
     6  traumatic  brain  injury  and one of whom shall be representative of the
     7  public and have a demonstrated expertise and interest in traumatic brain
     8  injury; two persons appointed by the speaker of  the  assembly,  one  of
     9  whom shall be a person with traumatic brain injury and one of whom shall
    10  be  representative  of  the public and have a demonstrated expertise and
    11  interest in traumatic brain injury, one person appointed by the minority
    12  leader of the senate who shall be a person with traumatic  brain  injury
    13  or be representative of the public and have a demonstrated expertise and
    14  interest  in  traumatic  brain  injury;  and one person appointed by the
    15  minority leader of the assembly who shall be  a  person  with  traumatic
    16  brain  injury or be representative of the public and have a demonstrated
    17  expertise and interest in traumatic brain injury. Of  the  five  persons
    18  appointed by the governor, three shall serve for a term of one year, one
    19  shall  serve  for  a term of two years and one shall serve for a term of
    20  three years. Of the two persons appointed by the temporary president  of
    21  the  senate, one shall serve for a term of two years and one shall serve
    22  for a term of three years. Of the two persons appointed by  the  speaker
    23  of  the  assembly, one shall serve for a term of two years and one shall
    24  serve for a term of three years. The person appointed  by  the  minority
    25  leader  of the senate and the person appointed by the minority leader of
    26  the assembly shall serve for a term of one year. Subsequent appointments
    27  for vacancies shall be for a term of three years and shall be filled  in
    28  the same manner as the original appointment.
    29    § 3. This act shall take effect immediately.
