        AN ACT to amend chapter 617 of the laws of 1937  relating  to  an  addi-
          tional  alternative  form of government for the county of Westchester,
          in relation to the authority of the state civil service commission  to
          administer the county service in Westchester

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Section 92 of chapter 617 of the laws of 1937, relating  to
     2  an additional alternative form of government for the county of Westches-
     3  ter, is amended to read as follows:
     4    §  92.  Civil service law to apply; powers and duties of the personnel
     5  officer. Except as otherwise provided by this act, all positions in  the
     6  county  service  shall be subject to the civil service law of the state.
     7  The personnel officer shall have with respect to the county service  the
     8  powers  and  duties of a municipal civil service commission [except that
     9  the state civil service commission shall continue to have  those  powers
    10  and  duties  specified  in  the  civil  service  law relating to (a) the
    11  assignment of positions in the  classified  service  to  exempt,  labor,
    12  non-competitive and competitive classes, or to such other classes as may
    13  be  established  generally  by rules of the commission, (b) the determi-
    14  nation of the merit and fitness of applicants and (c) the  certification
    15  of  lists  of  eligibles  for  appointment  to  positions  in the county
    16  service. The state civil service  commission,  in  certifying  lists  of
    17  eligibles  for  appointment  to  positions  in  the county service shall
    18  include in such lists only the names of residents of Westchester  county
    19  unless  specifically  instructed  otherwise  in writing by the personnel
    20  officer after approval by the county executive].
    21    § 2. Section 94 of chapter 617 of the laws of  1937,  relating  to  an
    22  additional alternative form of government for the county of Westchester,
    23  is amended to read as follows:
    24    §  94. Classification, rates of pay, personnel procedures. It shall be
    25  the duty of the personnel officer, as soon as practicable after this act
    26  become effective in the county, to recommend to the county executive for

     1  submission to the county board an act providing (a) for the  classifica-
     2  tion  of  positions  in  the  county  service on the basis of duties and
     3  responsibilities; (b) for schedules of pay for each position so that, as
     4  nearly as may be, equal pay may be given for equal work and responsibil-
     5  ity; (c) for an orderly procedure of administering all personnel matters
     6  except  those  matters reserved to the state civil service commission by
     7  the provisions of this article. [Such act or amendment thereto shall not
     8  become effective with respect to any procedure  involving  appointments,
     9  separations,  promotions,  demotions,  transfers or reinstatements until
    10  that procedure has been approved by the state civil service commission.]
    11  The county board shall within three months thereafter adopt such act  in
    12  the  original  or  some  modified form, and may thereafter, from time to
    13  time adopt amendments thereto  as  occasion  requires.  Classifications,
    14  rates  of  pay  and  procedures in force when this act becomes effective
    15  shall continue in force until modified by such act.
    16    § 3. This act shall take effect immediately.
