AN ACT to amend the public health law, in relation to requiring maternal
mortality review boards to share information with the New York city
department of health and mental hygiene and county health departments
on an annual basis, including the circumstances, common factors and
patterns, best practices and strategies, primary data, vital records
data, and any other guidance associated with reported cases of mater-
nal mortality and morbidity
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Paragraphs (d) and (e) of subdivision 5 of section 2509 of
2 the public health law, as amended by chapter 142 of the laws of 2019,
3 are amended and a new paragraph (f) is added to read as follows:
4 (d) shall issue a report on its findings and recommendations every two
5 years, and may also issue reports more frequently. The reports shall be
6 public documents; [and]
7 (e) may request and shall receive the assistance of the commissioner
8 in the instance of the state board and the city commissioner in the
9 instance of the city board in carrying out its functions[.]; and
10 (f) notwithstanding any provision of law, rule, or regulation to the
11 contrary, shall share the following information with the New York city
12 department of health and mental hygiene and with county health depart-
13 ments, on an annual basis, void of any personal identifying information,
14 pursuant to paragraph (c) of subdivision four and subdivision six of
15 this section, and provided that the departments are not permitted to
16 share such information with the public:
17 (i) the circumstances of such reported cases at any and all public and
18 private places in which the board has reason to believe, based on rele-
19 vant information available, that such places are associated with such
20 maternal death cases;
21 (ii) common factors associated with the cause of maternal deaths and
22 any patterns that may have emerged among the causes or cases themselves;

1 (iii) best practices and strategies for reducing the risk of maternal
2 mortality and morbidity;
3 (iv) primary data, as characterized by the state department of
4 health's community health assessment guidance as "information that is
5 collected first-hand by those conducting the assessment. This type of
6 data would include original information gathered through surveillance
7 activities, focus groups, interview and observations";
8 (v) vital records data, as defined for the purposes of this subdivi-
9 sion as "records of live births and deaths, including all data fields
10 collected and maintained by the state department of health to the extent
11 that such records or data fields are obtained, accessed, or used by any
12 such board"; and
13 (vi) any other guidance to reduce maternal mortality and morbidity
14 that the board determines to be appropriate.
15 § 2. This act shall take effect immediately.
