        AN ACT to amend the alcoholic beverage control law, in  relation  to  an
          exemption  for certain property in the village of Lake Placid from the
          prohibition of alcohol sales within a certain distance from a church

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  Subdivision  7  of  section  64 of the alcoholic beverage
     2  control law is amended by adding a  new  paragraph  (e-18)  to  read  as
     3  follows:
     4    (e-18)  Notwithstanding the provisions of paragraph (a) of this subdi-
     5  vision, the  authority  may  issue  a  retail  license  for  on-premises
     6  consumption  for  a  premises  which shall be located within two hundred
     7  feet of a building occupied exclusively as a school,  church,  synagogue
     8  or other place of worship, provided such premises constitutes a premises
     9  for the sale of food or beverages at retail for consumption on the prem-
    10  ises located wholly within the boundaries of the village of Lake Placid,
    11  town of North Elba, county of Essex, bounded and described as follows:
    12    ALL  THAT  CERTAIN  PIECE  OR  0.35 ACRE PARCEL OF LAND situate in the
    13  Village of Lake Placid, Town of North Elba, County of  Essex,  State  of
    14  New  York, being part of Lot 258, Township 11, Old Military Tract, Rich-
    15  ards' Survey lying west of the center of Main Street, so called, aka NYS
    16  Route 86, S.H. No. 1511, and said parcel being more  particularly  bound
    17  and described as follows:
    18    BEGINNING  at  a point in the east bounds of Main Street at the south-
    19  east corner of the premises herein described  and  being  the  northeast
    20  corner of the Episcopal Church of Lake Placid, located North 18° 08' 10"
    21  East,  129  feet, more or less, from the bounds of Hayes Street fka Park
    22  Street; thence North 69° 59' 28" West, 161.59 feet along the south  line
    23  of  the  parcel  to a point at the southwest corner marked by a 5/8 inch
    24  iron rod with a plastic cap, and said course passing through a 3/4  inch
    25  drill hole in a stone masonry retaining wall at a distance of 0.30 feet;
    26    Thence,  North 18° 27' 00" East, 90.24 feet along the west line of the
    27  premises marked by a decorative wire fence to a point at  the  northwest

     1  corner  and  marked  by a 5/8 inch iron rod, and said point being in the
     2  south line of a twenty (20')  foot  wide  right-of-way  in  common  with
     3  others  running  east/west  between  Elm Street fka Woodland Terrace and
     4  Main Street, and known as Margaret Place;
     5    Thence,  South  72°  17' 47" East, 161.02 feet along the south line of
     6  said right-of-way, Margaret Place, to a point in the west bounds of Main
     7  Street, and said point passing through a 1 inch iron pipe line marker at
     8  a distance of 2.01 feet, a 5/8 inch iron rod marker  at  a  distance  of
     9  98.66  feet,  and  a  masonry nail line marker in the center of concrete
    10  capped retaining wall at a distance of 153.61 feet;
    11    Thence, South 18° 08' 10" West, 96.73 feet along the  west  bounds  of
    12  Main  Street  to  the  Point-of-Beginning  and encompassing therein 0.35
    13  acres, more or less.
    14    TOGETHER WITH all right, title and interest in and to  the  center  of
    15  Main Street as the north and south lines are extended easterly thereto.
    16    TOGETHER  WITH  a  twenty  (20')  foot wide right-of-way over Margaret
    17  Place, so called, from Main Street to Elm Street  for  the  purposes  of
    18  ingress and egress and the connection to public utilities located there-
    19  in.
    20    TOGETHER  WITH AND SUBJECT TO the rights of the public in and to lands
    21  within any public  street,  any  and  all  easements,  restrictions  and
    22  right(s) of way of record, as the same may affect said premises.
    23    SAID  PREMISES also being known as and by the street address 2442 Main
    24  Street, Lake Placid, New York.
    25    BEING THE SAME PREMISES conveyed to CJDLP LLC from Kane Realty Manage-
    26  ment LLC by Deed dated June 30, 2025 and recorded in  the  Essex  County
    27  Clerk's Office on August 14, 2025 in Book 2210 of Deeds at Page 272.
    28    § 2. This act shall take effect immediately.
