McDonald) -- read once and referred to the Committee on Social Services AN ACT to amend the social services law, in relation to authorizing the department of social services to provide certain notice by electronic means when written authorization has been provided by the person receiving such notice The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 145-a of the social services law is amended by 2 adding a new subdivision 3 to read as follows: 3 3. Notwithstanding any other provision of law, where the department 4 has obtained written authorization from a provider or person, in such 5 form as may be prescribed by the Medicaid inspector general, the depart- 6 ment may use reasonably secure electronic means of communication to 7 furnish any notice the department is required to mail pursuant to law or 8 regulation. If the department furnishes such notice in accordance with 9 this section via reasonably secure electronic means and consistent with 10 the provider's authorization, department records of such transaction 11 shall constitute appropriate and sufficient proof of delivery thereof 12 and shall be admissible in any action or proceeding. 13 § 2.
