AN ACT to amend the public service law, in relation to net energy meter-
ing for certain residential customer-generators
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 66-j of the public service law is amended by adding
2 a new subdivision 4-a to read as follows:
3 4-a. Exemptions for certain residential customer-generators. Notwith-
4 standing any other provision of law, rule, or regulation to the contra-
5 ry, a residential customer-generator who owns or operates solar electric
6 generating equipment located and used at the residence, and powering up
7 to four residential units, shall be exempt from the value of distributed
8 energy resources, the value stack compensation methodology, or any other
9 compensation structure that provides anything other than watt-for-watt
10 compensation, and shall be credited using the net energy metering rates
11 pursuant to subdivision four of this section. Nothing in this section
12 shall prohibit interconnected residential customer-generators from
13 opting in to a compensation structure, other than net energy metering.
14 § 2. Section 66-l of the public service law is amended by adding a new
15 subdivision 4-a to read as follows:
16 4-a. Exemptions for certain residential customer-generators. Notwith-
17 standing any other provision of law, rule, or regulation to the contra-
18 ry, a residential customer-generator who owns or operates wind electric
19 generating equipment located and used at the residence, and powering up
20 to four residential units, shall be exempt from the value of distributed
21 energy resources, the value stack compensation methodology, or any other
22 compensation structure that provides anything other than watt-for-watt
23 compensation, and shall be credited using the net energy metering rates
24 pursuant to subdivision four of this section. Nothing in this section
25 shall prohibit interconnected residential customer-generators from
26 opting in to a compensation structure, other than net energy metering.
27 § 3. This act shall take effect on the sixtieth day after it shall
28 have become a law. Effective immediately, the addition, amendment and/or
29 repeal of any rule or regulation necessary for the implementation of
30 this act on its effective date are authorized to be made and completed
31 on or before such effective date.
