AN ACT to amend the insurance law, in relation to requiring insurance
coverage for salpingectomy for ovarian cancer prevention
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subsection (i) of section 3216 of the insurance law is
2 amended by adding a new paragraph 42 to read as follows:
3 (42) (A) Every insurer or nonprofit health service plan that provides
4 coverage for hospital, medical or surgical care on an expense-incurred
5 basis under health insurance policies issued or delivered in this state,
6 and every health maintenance organization that provides coverage for
7 hospital, medical or surgical care under contracts issued or delivered
8 in this state shall provide coverage for salpingectomy for ovarian
9 cancer prevention.
10 (B) (i) Except as provided in clause (ii) of this subparagraph,
11 salpingectomy coverage for ovarian cancer prevention required by this
12 paragraph shall not be subject to any copayment, coinsurance or deduct-
13 ible requirement.
14 (ii) If an insured or an enrollee is covered under a high deductible
15 health plan as defined in 26 USC 223, salpingectomy coverage for ovarian
16 cancer prevention required by this paragraph may be subject to the
17 deductible requirement of such high deductible plan.
18 § 2. Section 3221 of the insurance law is amended by adding a new
19 subsection (w) to read as follows:
20 (w) (1) Every insurer or nonprofit health service plan that provides
21 coverage for hospital, medical or surgical care on an expense-incurred
22 basis under health insurance policies issued or delivered in this state,
23 and every health maintenance organization that provides coverage for
24 hospital, medical or surgical care under contracts issued or delivered
25 in this state shall provide coverage for salpingectomy for ovarian
26 cancer prevention.
27 (2) (A) Except as provided in subparagraph (B) of this paragraph,
28 salpingectomy coverage for ovarian cancer prevention required by this

1 paragraph shall not be subject to any copayment, coinsurance or deduct-
2 ible requirement.
3 (B) If an insured or an enrollee is covered under a high deductible
4 health plan as defined in 26 USC 223, salpingectomy coverage for ovarian
5 cancer prevention required by this paragraph may be subject to the
6 deductible requirement of such high deductible plan.
7 § 3. Section 4303 of the insurance law is amended by adding a new
8 subsection (yy) to read as follows:
9 (yy) (1) Every insurer or nonprofit health service plan that provides
10 coverage for hospital, medical or surgical care to individuals or groups
11 on an expense-incurred basis under health insurance policies issued or
12 delivered in this state, and every health maintenance organization that
13 provides coverage for hospital, medical or surgical care to individuals
14 or groups under contracts issued or delivered in this state shall
15 provide coverage for salpingectomy for ovarian cancer prevention.
16 (2) (A) Except as provided in subparagraph (B) of this paragraph,
17 salpingectomy coverage for ovarian cancer prevention required by this
18 paragraph shall not be subject to any copayment, coinsurance or deduct-
19 ible requirement.
20 (B) If an insured or an enrollee is covered under a high deductible
21 health plan as defined in 26 USC 223, salpingectomy coverage for ovarian
22 cancer prevention required by this paragraph may be subject to the
23 deductible requirement of such high deductible plan.
24 § 4. This act shall take effect on the first of January next succeed-
25 ing the date on which it shall have become a law and shall apply to all
26 insurance policies, contracts and plans issued, renewed, modified,
27 altered or amended on or after such effective date.
