AN ACT to amend the public health law, in relation to the volunteer
emergency medical services infrastructure and response equipment grant
program
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The public health law is amended by adding a new section
2 3002-b to read as follows:
3 § 3002-b. Volunteer emergency medical services infrastructure and
4 response equipment grant program. 1. There is hereby established within
5 the New York state emergency medical services council, the volunteer
6 emergency medical services infrastructure and response equipment grant
7 program. The grant program shall be administered by the commissioner of
8 the division of homeland security and emergency services for the purpose
9 of awarding capital grants to support projects which sustain or enhance
10 emergency medical service operations, infrastructure and equipment,
11 including but not limited to buildings, training facilities, technology
12 and vehicles.
13 2. Subject to appropriation, grants shall be awarded each grant appli-
14 cation cycle on a competitive basis through an application process. The
15 commissioner of the division of homeland security and emergency services
16 shall provide updated information regarding the grant application cycle,
17 available funding, and additional grant information deemed relevant by
18 the commissioner prior to each grant application cycle.
19 3. Eligible entities that are located within the state and which serve
20 one or more municipalities in the state may apply for the grant program.
21 4. Each grant application cycle shall provide grants to:
22 (a) eligible facility projects; and
23 (b) eligible equipment projects.
24 5. The commissioner of the division of homeland security and emergency
25 services shall publish a report on the grant application cycle no later
26 than the thirtieth day after such grant application cycle has ended. The

1 report shall be published on the agency's website and shall include, but
2 not be limited to, the following information:
3 (a) the total available funding for the grant application cycle;
4 (b) the total number of applicants who applied for a grant during the
5 grant application cycle and, for each applicant:
6 (i) the total number of active emergency medical technicians and inac-
7 tive emergency medical technicians in each voluntary ambulance service;
8 and
9 (ii) the total amount requested per project type, per county; and
10 (c) a list of all awardees which shall include:
11 (i) each municipality and county served by awardee; and
12 (ii) the total amount awarded per project type and per county.
13 6. The commissioner of the division of homeland security and emergency
14 services shall be authorized to promulgate rules and regulations to
15 carry out the provisions of this section. Such rules and regulations may
16 be included in the grant application and published on the agency's
17 website.
18 7. For the purposes of this section, the following terms shall have
19 the following meanings:
20 (a) "Available funding" shall mean the total appropriation made to the
21 volunteer emergency medical services infrastructure and response equip-
22 ment grant program and shall include the total available funding that
23 will be awarded in the grant application cycle for each type of grant
24 project and the maximum award for each grant project and each grantee.
25 (b) "Eligible equipment project" shall mean a project to support the
26 repair, enhancement and installation of equipment used to support emer-
27 gency medical service operations including, but not limited to vehicles,
28 emergency medical technician rehabilitation equipment, communications
29 technology and other safety equipment.
30 (c) "Eligible entity" shall include a voluntary ambulance service as
31 defined in section three thousand one of this article.
32 (d) "Eligible facility project" shall mean a project for the acquisi-
33 tion, construction, renovation, rehabilitation and leasehold improve-
34 ments of buildings owned or utilized by a voluntary ambulance service in
35 the provision of services to the community served by the voluntary ambu-
36 lance service, including, but not limited to, training facilities and
37 infrastructure improvements to such buildings. For the purposes of this
38 subdivision, electrical upgrades to a facility may be deemed to be
39 infrastructure improvements.
40 (e) "Grant application cycle" shall mean the period of time determined
41 by the commissioner of the division of homeland security and emergency
42 services that begins on the first day an applicant can submit an appli-
43 cation and ends no later than the sixtieth day after grant applicants
44 are notified of award decisions.
45 § 2. This act shall take effect on the first of April next succeeding
46 the date on which it shall have become a law. Effective immediately, the
47 addition, amendment and/or repeal of any rule or regulation necessary
48 for the implementation of this act on its effective date are authorized
49 to be made and completed on or before such effective date.
