        AN ACT to amend the public authorities law, in relation to  establishing
          a lithium-ion battery safety program
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Section 1854 of the public authorities law  is  amended  by
     2  adding a new subdivision 27 to read as follows:
     3    27.  Lithium-ion  battery  safety  program.  (a)  For purposes of this
     4  subdivision, the following terms shall have the following meanings:
     5    (i) "Lithium-ion battery" means a storage battery in  which  an  elec-
     6  trical  current  is  generated  by  lithium  ions  embedded  in a carbon
     7  graphite or nickel metal-oxide  substrate  placed  in  a  high-viscosity
     8  carbonate mixture or gelled polymer electrolyte.
     9    (ii)  "Delivery service worker" means an individual who performs pick-
    10  up, transportation, and delivery of food, goods, or packages for compen-
    11  sation, whether through an app-based platform, a third-party network, or
    12  direct employment by a business offering delivery services.
    13    (iii) "Powered mobility device" means a bicycle with  electric  assist
    14  as  defined by section one hundred two-c of the vehicle and traffic law,
    15  an electric scooter as defined by section one hundred fourteen-e of  the
    16  vehicle  and traffic law, a limited use motorcycle as defined by section
    17  one hundred twenty-one-b of  the  vehicle  and  traffic  law,  which  is
    18  powered  wholly  or partially by an electric motor, an electric personal
    19  assistive mobility device as defined in section one  hundred  fourteen-d
    20  of  the  vehicle  and  traffic  law  or  other  personal mobility device
    21  equipped with a lithium-ion or other storage battery, including but  not
    22  limited to, a skateboard, unicycle, or other similar wheeled device.

     1    (iv)  "Accredited  testing  laboratory"  means a nationally recognized
     2  testing laboratory as recognized by the federal occupational safety  and
     3  health  administration or an independent laboratory that has been certi-
     4  fied by an accrediting body to ISO 17025 or ISO 17065.
     5    (v) "Program" means the program developed pursuant to paragraph (b) of
     6  this subdivision.
     7    (b)  No  later than one year after the effective date of this subdivi-
     8  sion, the authority, in collaboration with the  department  of  environ-
     9  mental  conservation and any other appropriate agency, shall develop and
    10  administer a program to provide rebates for new  lithium-ion  batteries,
    11  and  to  provide new lithium-ion batteries at a reduced cost in exchange
    12  for used lithium-ion batteries, to delivery service workers for  powered
    13  mobility  devices  at  reduced  cost or no cost to eligible individuals;
    14  provided, however, that such rebates or cost reductions shall  cover  no
    15  more than fifty-five percent of the cost of such lithium-ion batteries.
    16    (c)  Individuals  utilizing  power  mobility devices solely for recre-
    17  ational purposes shall not be eligible for the program.
    18    (d) Delivery service workers earning above three  hundred  percent  of
    19  the federal poverty level shall not be eligible for the program.
    20    (e)  The  program  shall include either rebates or the exchange of new
    21  lithium-ion batteries at a reduced cost for used lithium-ion  batteries,
    22  pursuant to paragraph (b) of this subdivision.
    23    (f)  To  be  eligible for a rebate or reduced cost lithium-ion battery
    24  under the program, a delivery service worker applying  to  such  program
    25  shall:
    26    (i)  have  earned  at least one thousand five hundred dollars over the
    27  twelve months preceding the application submission period as a  delivery
    28  service worker;
    29    (ii)  own  an  eligible  powered  mobility  device that is in operable
    30  condition;
    31    (iii) be at least eighteen years of age; and
    32    (iv) reside in New York state.
    33    (g) Within one year of the effective date  of  this  subdivision,  the
    34  authority  shall  implement  and  administer  this subdivision including
    35  promulgating rules relating to the forms required to claim a  rebate  or
    36  exchange  a  used  lithium-ion  battery  for  a reduced cost lithium-ion
    37  battery, the required documentation for establishing eligibility, proce-
    38  dures and guidelines for claiming a rebate or exchanging  a  lithium-ion
    39  battery  for  a  reduced cost lithium-ion battery, and the collection of
    40  economic impact data from applicants  and  any  other  requirements  the
    41  authority deems necessary.
    42    (h)  All  new  batteries  provided  at  a reduced cost pursuant to the
    43  program shall be certified  by  an  accredited  testing  laboratory  for
    44  compliance  with  a  battery standard referenced in UL 2849, UL 2271, UL
    45  2272 or EN 15194, or such other safety standard approved by the  depart-
    46  ment  of  state  pursuant to regulation. Such certification or the logo,
    47  wordmark, or  name  of  such  accredited  testing  laboratory  shall  be
    48  displayed  on packaging or documentation at the time of sale for a prod-
    49  uct or directly on such product itself.
    50    (i) The authority shall collaborate with relevant agencies to  develop
    51  and  distribute  educational  materials  and conduct outreach efforts to
    52  inform eligible individuals about the program and the application  proc-
    53  ess for its services.
    54    (j)  No  later than April first, two thousand twenty-six, and annually
    55  thereafter, the authority shall issue a  report  to  the  governor,  the
    56  temporary  president  of  the  senate,  and  the speaker of the assembly

     1  detailing the status of the program. Such  report  shall  at  a  minimum
     2  include:
     3    (i)  the  amount of funding dedicated by the authority for the program
     4  in the preceding year;
     5    (ii) the number of rebates awarded;
     6    (iii) the number of exchanges provided;
     7    (iv) the amount and geographic distribution of rebates; and
     8    (v) any other information the authority deems necessary.
     9    § 2. This act shall take effect immediately.
