Provides that any special act school districts established pursuant to Chapter 566 of the Laws of 1967 shall be held harmless from any reduction in tuition revenue or any tuition rate calculation and/or rate reconciliation arising out of intake closure or limits on the entry of new student placements.

AN ACT in relation to tuition revenue and tuition rate calculations and
rate reconciliation for certain special act school districts
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Notwithstanding any provision of law, rule, or regulation
2 to the contrary, any special act school district established pursuant to
3 chapter 566 of the laws of 1967, as amended, subject to an intake
4 closure or limit on the entry of new student placements during the
5 2023-2024 school year or the 2024-2025 school year by the New York state
6 office of children and family services or the New York state office of
7 mental health, shall be held harmless from any reduction in tuition
8 revenue or any tuition rate calculation and/or rate reconciliation aris-
9 ing out of such intake closure or limit on the entry of new student
10 placements during the 2023-2024 school year or the 2024-2025 school
11 year. The commissioner of education is hereby directed to substitute
12 2022-2023 school year pupil counts reported by any special act school
13 district under this act to calculate and finalize any tuition rate
14 and/or tuition rate reconciliation for such special act school district
15 and shall submit such tuition rate and/or tuition rate reconciliation to
16 the director of the budget and the director of the budget is hereby
17 directed to approve such submittal. In the event such special act school
18 district under this act sustains a reduction in tuition revenue for the
19 2023-2024 school year or the 2024-2025 school year, the school district
20 shall submit a claim for reimbursement to the commissioner of education
21 no later than July 31, 2025 for the amount of such reduction in tuition
22 revenue including an accounting in writing of how such reduction in
23 tuition revenue was calculated and the director of the budget is hereby
24 directed to approve and pay such claim.
25 § 2. This act shall take effect immediately.
