AN ACT to amend the public authorities law, in relation to requiring
approval by the comptroller for a toll increase by the New York state
thruway authority
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subdivision 8 of section 354 of the public authorities law,
2 as amended by section 2 of part TT of chapter 54 of the laws of 2016, is
3 amended to read as follows:
4 8. (a) Subject to agreements with noteholders or bondholders, to fix
5 and collect such fees, rentals and charges for the use of the thruway or
6 any part thereof necessary or convenient, with an adequate margin of
7 safety, to produce sufficient revenue to meet the expense of maintenance
8 and operation and to fulfill the terms of any agreements made with the
9 holders of its notes or bonds, and to establish the rights and privi-
10 leges granted upon payment thereof.
11 (b) Notwithstanding any other law, rule or regulation to the contrary,
12 prior to any increase in the fees, rentals and charges authorized in
13 paragraph (a) of this subdivision, the authority shall submit such
14 proposed increase to the comptroller for review and approval. The comp-
15 troller shall review any such proposed increase and within sixty days
16 make public a report of such comptroller's findings and approval or
17 disapproval. A copy of the comptroller's report shall be sent to the
18 authority, the governor, the chair of the senate finance committee, the
19 chair of the assembly ways and means committee and the ranking minority
20 member of each of such committees.
21 § 2. This act shall take effect immediately.
