        AN  ACT  to  amend  the vehicle and traffic law, in relation to allowing
          severely disabled individuals to renew parking permits without provid-
          ing an updated medical certification or additional medical documents
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.    Paragraph (i) of subdivision 1 of section 1203-a of the
     2  vehicle and traffic law, as amended by chapter 180 of the laws of  1996,
     3  is amended and a new subdivision 1-a is added to read as follows:
     4    (i)  any resident of New York state who is a severely disabled person,
     5  as defined in subdivision [three] four of section four hundred four-a of
     6  this chapter, upon application of such person or such person's parent or
     7  guardian, provided, however, that an issuing agent shall  issue  permits
     8  only  to  residents  of  the city, town or village in which such issuing
     9  agent is located, except that, an issuing agent, in [his or  her]  their
    10  discretion,  may issue a permit to a severely disabled person who is not
    11  a resident of the city, town, or village in which such issuing agent  is
    12  located  where  such person resides in a city, town, or village in which
    13  the governing body has not appointed an issuing agent;  and  an  issuing
    14  agent,  in  [his or her] their discretion, may issue a temporary special
    15  vehicle identification parking  permit,  as  authorized  by  subdivision
    16  three of this section, to a person who is temporarily unable to ambulate
    17  without the aid of an assisting device, as certified by a physician, who
    18  resides  in a city, town, or village in which the issuing agent does not
    19  issue temporary special vehicle identification parking permits,  or  who
    20  is  not  a resident of the United States and is temporarily visiting the
    21  state; or
 
         EXPLANATION--Matter in italics (underscored) is new; matter in brackets
                              [ ] is old law to be omitted.

     1    1-a. Any resident of New York state who is a severely disabled person,
     2  as defined in subdivision four of section four hundred  four-a  of  this
     3  chapter,  shall  not  be  required to provide an updated medical certif-
     4  ication or additional medical documents upon application for renewal  of
     5  a  permit  issued  pursuant  to this section.   For the purposes of this
     6  subdivision, the term "permit" shall not  include  a  temporary  special
     7  vehicle identification parking permit issued pursuant to this section to
     8  a  person  who  is  temporarily unable to ambulate without the aid of an
     9  assisting device.
    10    § 2. This act shall take effect immediately.
