AN ACT to amend the public service law and the public authorities law,
in relation to requiring the results of any outage management system
stress test conducted in the state by a utility company to be posted
online
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The public service law is amended by adding a new section
2 54 to read as follows:
3 § 54. Utility outage management system stress testing. 1. For
4 purposes of this section, "outage management system stress test" shall
5 mean a test conducted by a utility to determine the ability of such
6 utility to handle and respond to large scale weather events or natural
7 disasters that are likely to result in the loss of service to customers.
8 2. (a) The department shall post the results of any outage management
9 system stress test conducted in the state by a gas, electric, or combi-
10 nation gas and electric utility corporation, or municipal electric or
11 gas on the department's website as soon as such results become avail-
12 able.
13 (b) The commission shall also submit an annual report of such results
14 to the governor, the temporary president of the senate, the speaker of
15 the assembly and the chairs of the senate and assembly standing commit-
16 tees on energy.

1 § 2. Title 1-A of article 5 of the public authorities law, as added by
2 chapter 517 of the laws of 1986, is amended by adding a new section
3 1020-oo to read as follows:
4 § 1020-oo. Outage management system stress testing. 1. For purposes
5 of this section, "outage management system stress test" shall mean a
6 test conducted by the authority or a service provider to determine the
7 ability of the authority or such service provider to handle and respond
8 to large scale weather events or natural disasters that are likely to
9 result in the loss of service to customers.
10 2. (a) The authority shall post the results of any outage management
11 system stress test conducted by the authority or a service provider on
12 the authority's website as soon as such results become available.
13 (b) The board shall also submit a report of such results to the gover-
14 nor, the temporary president of the senate, the speaker of the assembly
15 and the chairs of the senate and assembly standing committees on energy.
16 § 3. The public service law is amended by adding a new section 89-q to
17 read as follows:
18 § 89-q. Utility outage management system stress testing. 1. For
19 purposes of this section, "outage management system stress test" shall
20 mean a test conducted by a utility to determine the ability of such
21 utility to handle and respond to large scale weather events or natural
22 disasters that are likely to result in the loss of service to customers.
23 2. (a) The department shall post the results of any outage management
24 system stress test conducted in the state by a waterworks corporation,
25 or municipal water systems on the department's website as soon as such
26 results become available.
27 (b) The commission shall also submit an annual report of such results
28 to the governor, the temporary president of the senate, the speaker of
29 the assembly and the chairs of the senate and assembly standing commit-
30 tees on energy.
31 § 4. This act shall take effect immediately.
