AN ACT to amend the penal law, in relation to establishing the ammuni-
tion purchase certification act
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. This act shall be known as the "ammunition purchase certif-
2 ication act".
3 § 2. The penal law is amended by adding a new section 400.04 to read
4 as follows:
5 § 400.04 Ammunition purchase permit number.
6 1. No person shall purchase ammunition in this state without a valid
7 ammunition purchase permit number issued by the division of state
8 police. The division of state police shall serve as the point of
9 contact for the processing of ammunition purchasing permits and shall
10 establish criteria and procedures for the issuance, renewal, suspension,
11 and revocation of such permits.
12 2. An ammunition purchase permit shall be issued subsequent to an
13 individual passing the required background check for the purchase of
14 ammunition or after approval via application, as determined by the divi-
15 sion of state police, and shall be valid for a period of one year from
16 such initial purchase or date of issue. There shall be no additional fee
17 for such issuance. The current fee of two dollars and fifty cents shall
18 be charged at the time of the initial purchase or filing of the applica-
19 tion and any subsequent renewal.
20 3. Each permit shall be a physical permit card with a unique identifi-
21 cation number. From the date of issuance, purchasers shall use either
22 the permit card or its unique identification number when purchasing
23 ammunition.
24 4. The permit number may be renewed for a subsequent period of one
25 year upon a valid purchase after the expiration of such permit number.

1 5. An ammunition purchase permit number may be revoked at any time by
2 the division of state police.
3 6. The division of state police shall notify the holder of an ammuni-
4 tion purchase permit of the suspension or revocation of their permit in
5 writing by certified mail and such suspension or revocation shall be
6 noted in the statewide license and record database for licensees and
7 sellers.
8 7. A person who purchases ammunition without a valid ammunition
9 purchase permit number is guilty of a class A misdemeanor.
10 § 3. This act shall take effect on the first day of the twelfth month
11 after it shall have become a law.
