AN ACT to amend the executive law, in relation to requiring documents
utilized by state agencies, public authorities and municipalities
to replace the term "emotionally disturbed person" with the term
"person experiencing an emotional crisis"
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The executive law is amended by adding a new section 170-i
2 to read as follows:
3 § 170-i. Mental health references contained in state and municipal
4 forms. No form, preprinted document, other public-facing document,
5 training material, agency guidance, or manual utilized by a state agen-
6 cy, public authority or municipality shall use the term "emotionally
7 disturbed person" to identify or denote a person experiencing emotional
8 distress or an emotional or mental health crisis. All forms or
9 preprinted documents, other public-facing documents, training materials,
10 agency guidance or manuals utilizing such term shall be amended no later
11 than January first, two thousand twenty-six to replace the term
12 "emotionally disturbed person" with the term "person experiencing an
13 emotional crisis".
14 § 2. This act shall take effect on the one hundred eightieth day
15 after it shall have become a law. Effective immediately, the addition,
16 amendment and/or repeal of any rule or regulation necessary for the
17 implementation of this act on its effective date are authorized to be
18 made and completed on or before such effective date.
