        AN  ACT  to  amend the education law, in relation to registered pharmacy
          technicians
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  Subdivision  1  of  section 6841 of the education law, as
     2  amended by chapter 543 of the laws  of  2025,  is  amended  to  read  as
     3  follows:
     4    1.  A  registered pharmacy technician may, under the direct [personal]
     5  supervision of a licensed pharmacist, assist such  licensed  pharmacist,
     6  as directed, in compounding, preparing, labeling, or dispensing of drugs
     7  used to fill valid prescriptions or medication orders or in compounding,
     8  preparing, and labeling in anticipation of a valid prescription or medi-
     9  cation  order  for a patient to be served by the pharmacy, in accordance
    10  with article one hundred thirty-seven of this  title  where  such  tasks
    11  require  no professional judgment. Such professional judgment shall only
    12  be exercised by a licensed pharmacist.  A registered pharmacy technician
    13  may only practice under the direct [personal] supervision of a  licensed
    14  pharmacist employed in such a pharmacy. A registered pharmacy technician
    15  may  administer  the  same  immunizations  as  licensed  pharmacists are
    16  authorized to administer under the  direct  supervision  of  a  licensed
    17  pharmacist consistent with the training and other requirements in  arti-
    18  cle  one hundred thirty-seven of this title as determined by the depart-
    19  ment.  Training shall include certification in cardiopulmonary  resusci-

     1  tation  or  basic  life  support. A registered pharmacy technician shall
     2  obtain an immunization certificate from the department after demonstrat-
     3  ing that they have met  all  requirements  and prior  to   administering
     4  immunizations.  Such pharmacy shall be responsible for ensuring that the
     5  registered pharmacy technician  has  received  appropriate  training  to
     6  ensure  competence  before  beginning to assist a licensed pharmacist in
     7  compounding, preparing, labeling,  administering      immunizations,  or
     8  dispensing  of  drugs,  in  accordance with this article and article one
     9  hundred thirty-seven of this title. For the purposes  of  this  article,
    10  direct  [personal]  supervision means supervision of procedures based on
    11  instructions given directly by a  supervising  licensed  pharmacist  who
    12  remains  in  the immediate area where the procedures are being performed
    13  or is immediately available at the same location where  an  immunization
    14  is  being  administered,  authorizes  the  procedures  and evaluates the
    15  procedures performed by the registered pharmacy technicians and a super-
    16  vising licensed pharmacist shall  approve  all  work  performed  by  the
    17  registered  pharmacy  technician  prior  to the actual dispensing of any
    18  drug.
    19    § 2. This act shall take effect on the sixtieth  day  after  it  shall
    20  have become a law.
