        AN ACT to amend the education law, in relation to inclusive  instruction
          and instructional materials
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. The education law is amended by adding a new section  804-e
     2  to read as follows:
     3    §  804-e.  Task  force on model curriculum or instruction of the poli-
     4  tical, economic, and social contributions of the LGBTQIA  community.  1.
     5  There  is  hereby created a task force to study and make recommendations
     6  on model curriculum or  instruction  of  the  political,  economic,  and
     7  social  contributions  of  lesbian,  gay,  bisexual, transgender, queer,
     8  intersex, and asexual people, in an appropriate place in the  curriculum
     9  of  middle  school  and high school students.  The task force shall also
    10  study and make recommendations on policies, procedures  and  best  prac-
    11  tices  for the selection and adoption of inclusive instructional materi-
    12  als for such model curriculum.
    13    2. The task force shall be composed of eleven members to be  appointed
    14  as follows:
    15    (a) two members shall be appointed by the governor;
    16    (b)  two  members shall be appointed by the temporary president of the
    17  senate;
    18    (c) two members shall be appointed by the speaker of the assembly;
    19    (d) one member shall be  appointed  by  the  minority  leader  of  the
    20  senate;
    21    (e) one member shall be appointed by the minority leader of the assem-
    22  bly;

     1    (f)  two  members shall be appointed by the chancellor of the board of
     2  regents; and
     3    (g) one member shall be the commissioner or appointed designee thereof
     4  who shall serve as chairperson of the task force.
     5    3. All appointments to the task force shall be submitted no later than
     6  one  hundred  twenty  days after the effective date of this subdivision.
     7  Vacancies in the membership of the task force  shall  be  filled  within
     8  thirty  days  in  the  same  manner  provided for original appointments.
     9  Appointed members shall be chosen with due regard to broad ethnic, sexu-
    10  al orientation, and gender identity or expression  diversity  and  shall
    11  have  a  demonstrated educational background in the history of the poli-
    12  tical, economic, and social contributions  of  lesbian,  gay,  bisexual,
    13  transgender, queer, intersex, and asexual people.
    14    4.  The members of the task force shall serve without compensation but
    15  shall be reimbursed for necessary expenses incurred in  the  performance
    16  of their duties.
    17    5. The task force shall study and prepare a report on model curriculum
    18  or  instruction,  policies,  procedures and best practices to provide an
    19  inclusive curriculum on the political,  economic,  and  social  contrib-
    20  utions  of  lesbian,  gay,  bisexual,  transgender, queer, intersex, and
    21  asexual people.   The report shall be submitted  to  the  governor,  the
    22  temporary  president  of  the  senate,  the speaker of the assembly, the
    23  chairperson of the senate committee on education, the chairperson of the
    24  senate committee on New York city  education,  the  chairperson  of  the
    25  assembly  committee  on education, the board of regents, and the commis-
    26  sioner, no later than one year after all  initial  appointments  to  the
    27  task force have been made.
    28    §  2.  This act shall take effect on the first of July next succeeding
    29  the date on which it shall have become a law and shall apply  to  school
    30  years  commencing  on  or  after such date.   Effective immediately, the
    31  addition, amendment and/or repeal of any rule  or  regulation  necessary
    32  for  the implementation of this act on its effective date are authorized
    33  to be made and completed on or before such effective date.
