AN ACT to amend the administrative code of the city of New York, in
relation to the placement of homeless shelters
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The administrative code of the city of New York is amended
2 by adding a new section 21-124.2 to read as follows:
3 § 21-124.2 Placement of homeless shelters. a. No homeless shelter
4 shall be established within five hundred feet of any transit facility
5 nor within a building that has a rent-controlled or rent-stabilized
6 dwelling unit.
7 b. For the purposes of this section, the term "transit facility" shall
8 mean a rapid transit railroad, omnibus line or any other facility or any
9 railroad in the city used for local service in the transportation of
10 passengers as common carriers for hire or in the transportation of the
11 United States mail or personal property, and any portion thereof and the
12 rights, leaseholds or other interests therein, together with the devices
13 and appurtenances, facilities and equipment thereof and power plants and
14 other instrumentalities used or useful therefor or in connection there-
15 with.
16 § 2. This act shall take effect on the ninetieth day after it shall
17 have become a law.
