AN ACT to create a temporary state commission to study and make recom-
mendations concerning the incidence of asthma in the borough of the
Bronx in New York city
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. A temporary state commission is hereby created to study and
2 make recommendations relating to the incidence of asthma in the borough
3 of the Bronx in New York, which has the highest incidence of asthma in
4 the state. The commission will place particular emphasis on youth in
5 communities with an unemployment rate exceeding one hundred twenty-five
6 percent of the statewide level.
7 § 2. The commission shall consist of eleven members to be appointed as
8 follows: five shall be appointed by the governor; two shall be appointed
9 by the temporary president of the senate and one by the minority leader
10 of the senate; and two shall be appointed by the speaker of the assembly
11 and one by the minority leader of the assembly. The members of the
12 commission shall serve at the pleasure of the official making the
13 appointment of such member. Of the five members appointed by the gover-
14 nor, one shall be from the department of health and one shall be from
15 the department of environmental conservation. The remaining nine members
16 of the commission must reside in a city with a population of one million
17 or more. Vacancies in the membership of the commission shall be filled
18 in the manner provided for original appointments. Membership on the
19 commission shall not constitute a public office. A chairperson and vice-
20 chairperson of the commission shall be elected by a majority of its
21 members, all members being present.
22 § 3. The members of the commission shall receive no compensation for
23 their services, but shall be allowed their actual and necessary expenses
24 incurred in the performance of their duties pursuant to this act.

1 § 4. The commission may meet within and without the state, shall hold
2 at least one public hearing each quarter, and shall have all the powers
3 of a legislative committee pursuant to the legislative law.
4 § 5. The commission shall make a report of its findings and make any
5 recommendations it may deem necessary and appropriate to the governor,
6 the temporary president of the senate and the speaker of the assembly no
7 later than one year after the effective date of this act.
8 § 6. This act shall take effect immediately.
