AN ACT to amend the state finance law, in relation to reporting require-
ments for certain funds
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subdivision 5 of section 95-i of the state finance law, as
2 added by chapter 290 of the laws of 2018, is amended to read as follows:
3 5. (a) As a condition of receiving grants from the fund, the Greater
4 New York ALS Association and the ALS Association Upstate New York Chap-
5 ter shall agree to issue and shall issue, on or before the first day of
6 February each year, a report including, but not limited to, financial
7 statements, financial reports and reports on the issuance of grants.
8 Such reports shall be delivered to the governor, the temporary president
9 of the senate, the speaker of the assembly, and the chairs of the senate
10 finance committee and the assembly ways and means committee and shall
11 also be made available to the public. Such financial statements and
12 reports shall be audited by a nationally recognized accounting firm.
13 Such report shall include how the monies of the fund were utilized
14 during the preceding calendar year, and shall include:
15 (i) the amount of money dispersed from the fund;
16 (ii) recipients of awards from the fund and how such recipients were
17 selected;
18 (iii) the amount awarded to each recipient;
19 (iv) the purposes for which such awards were granted;
20 (v) a summary financial plan for such monies which shall include esti-
21 mates of all receipts and all disbursements for the current and succeed-
22 ing fiscal years, along with the actual results from the prior fiscal
23 year; and

1 (vi) an explanation of why any remaining funds were not utilized, if
2 applicable.
3 (b) Such report shall be made available to the public on the depart-
4 ment of health's website. Should a report not be made available by the
5 first day of February each year, the department shall update its website
6 to inform the public that such report is not yet available and provide
7 an expected release date.
8 § 2. Subdivisions 2-b and 5 of section 89-e of the state finance law,
9 subdivision 2-b as amended by chapter 453 of the laws of 2015, and
10 subdivision 5 as added by chapter 590 of the laws of 1999, are amended
11 to read as follows:
12 2-b. (a) On or before the first day of February each year, the commis-
13 sioner of health shall provide a written report to the governor, the
14 temporary president of the senate, the speaker of the assembly, the
15 chair of the senate finance committee, the chair of the assembly ways
16 and means committee, the chair of the senate committee on health, the
17 chair of the assembly health committee, the state comptroller, and the
18 public. Such report shall include how the monies of the fund were
19 utilized during the preceding calendar year and shall include:
20 (i) the amount of money dispersed from the fund [and the award process
21 used for such disbursements];
22 (ii) recipients of awards from the fund and how such recipients were
23 selected;
24 (iii) the amount awarded to each recipient;
25 (iv) the purposes for which such awards were granted; [and]
26 (v) a summary financial plan for such monies which shall include esti-
27 mates of all receipts and all disbursements for the current and succeed-
28 ing fiscal years, along with the actual results from the prior fiscal
29 year; and
30 (vi) an explanation of why any remaining funds were not utilized, if
31 applicable.
32 (b) Such report shall be made available to the public on the depart-
33 ment of health's website. Should a report not be made available by the
34 first day of February each year, the department shall update its website
35 to inform the public that such report is not yet available and provide
36 an expected release date.
37 5. (a) All payments [form] from such fund shall be made by the depart-
38 ment of taxation and finance after audit and warrant of the comptroller
39 on vouchers approved by the commissioner of health.
40 (b) The commissioner of health shall expend funds in the year in which
41 they were donated to the extent practicable.
42 § 3. Subdivision 2-a of section 95-e of state finance law, as amended
43 by section 7 of part AA of chapter 56 of the laws of 2020, is amended to
44 read as follows:
45 2-a. (a) On or before the first day of February each year, the comp-
46 troller shall certify to the governor, the temporary president of the
47 senate, the speaker of the assembly, the chair of the senate finance
48 committee, and the chair of the assembly ways and means committee the
49 amount of money deposited in the autism awareness and research fund
50 during the preceding calendar year as the result of revenue derived
51 pursuant to section six hundred thirty-d of the tax law, as added by
52 chapter 483 of the laws of 2015.
53 (b) On or before the first day of February each year, the commissioner
54 of the office for people with developmental disabilities shall provide a
55 written report to the governor, the temporary president of the senate,
56 the speaker of the assembly, the chair of the senate finance committee,

1 the chair of the assembly ways and means committee, the chair of the
2 senate committee on health, the chair of the assembly health committee,
3 the state comptroller, and the public. Such report shall include how
4 the monies of the fund were utilized during the preceding calendar year,
5 and shall include:
6 (i) the amount of money disbursed from the fund and the award process
7 used for such disbursements;
8 (ii) recipients of awards from the fund and how such recipients were
9 selected;
10 (iii) the amount awarded to each recipient;
11 (iv) the purposes for which such awards were granted; [and]
12 (v) a summary financial plan for such monies which shall include esti-
13 mates of all receipts and all disbursements for the current and succeed-
14 ing fiscal years, along with the actual results from the prior fiscal
15 year; and
16 (vi) an explanation of why any remaining funds were not utilized, if
17 applicable.
18 (c) Such report shall be made available to the public on the office
19 for people with developmental disabilities' website. Should a report not

23 § 4. Subdivision 2-b of section 97-yy of the state finance law, as
24 amended by chapter 453 of the laws of 2015, is amended to read as
25 follows:
26 2-b. (a) On or before the first day of February each year, the commis-

28 temporary president of the senate, the speaker of the assembly, the
29 chair of the senate finance committee, the chair of the assembly ways

51 § 5. Subdivision 2-b of section 99-z of the state finance law, as
52 added by chapter 443 of the laws of 2016, is amended to read as follows:
53 2-b. (a) On or before the first day of February each year, the commis-
54 sioner of health shall provide a written report to the governor, the
55 temporary president of the senate, the speaker of the assembly, the
56 chair of the senate finance committee, the chair of the assembly ways

1 and means committee, the chair of the senate committee on health, the
2 chair of the assembly health committee, the state comptroller, and the
3 public. Such report shall include how the monies of the fund were
4 utilized during the preceding calendar year, and shall include:
5 (i) the amount of money disbursed from the fund and the award process

7 (ii) recipients of awards from the fund and how such recipients were
8 selected;
9 (iii) the amount awarded to each recipient;
10 (iv) the purposes for which such awards were granted; [and]

22 § 6. Subdivision 7 of section 89-k of the state finance law, as added
23 by chapter 548 of the laws of 2023, is amended to read as follows:
24 7. (a) On or before the first day of February each year, the commis-
25 sioner of health shall provide a written report to the governor, the
26 temporary president of the senate, the speaker of the assembly, the
27 chair of the senate finance committee, the chair of the assembly ways
28 and means committee, the chair of the senate committee on health, the
29 chair of the assembly health committee, and the public. Such report
30 shall include how the monies of the fund were utilized during the
31 preceding calendar year and shall include:
32 (i) the amount of money disbursed from the fund;
33 (ii) recipients of awards from the fund and how such recipients were
34 selected;
35 (iii) the amount awarded to each recipient; [and]
36 (iv) the purposes for which such awards were granted;
37 (v) a summary financial plan for such monies which shall include esti-
38 mates of all receipts and all disbursements for the current and succeed-
39 ing fiscal years, along with the actual results from the prior fiscal
40 year; and
41 (vi) an explanation of why any remaining funds were not utilized, if
42 applicable.
43 (b) Such report shall be made available to the public on the depart-

48 § 7. Subdivision 7 of section 95-k of the state finance law, as added
49 by chapter 444 of the laws of 2022, is amended to read as follows:
50 7. (a) On or before the first day of February each year, the commis-
51 sioner of the department of health shall provide a written report to the
52 governor, the temporary president of the senate, the speaker of the
53 assembly, the minority leader of the senate, the minority leader of the
54 assembly, the chair of the senate finance committee, the chair of the
55 assembly ways and means committee, the chair of the senate committee on
56 health, [and] the chair of the assembly health committee, and the

1 public. Such report shall include how the monies of the fund were
2 utilized during the preceding calendar year and shall include:
3 (i) the amount of money dispersed from the fund;
4 (ii) recipients of awards from the fund and how such recipients were
5 selected;
6 (iii) the amount awarded to each recipient; [and]
7 (iv) the purposes for which such awards were granted;
8 (v) a summary financial plan for such monies which shall include esti-
9 mates of all receipts and all disbursements for the current and succeed-
10 ing fiscal years, along with the actual results from the prior fiscal
11 year; and
12 (vi) an explanation of why any remaining funds were not utilized, if
13 applicable.
14 (b) Such report shall be made available to the public on the depart-
15 ment of health's department website. Should a report not be made avail-
16 able by the first day of February each year, the office shall update its
17 website to inform the public that such report is not yet available and
18 provide an expected release date.
19 § 8. Section 97-j of the state finance law is amended by adding three
20 new subdivisions 6, 7 and 8 to read as follows:
21 6. On or before the first day of February each year, the comptroller
22 shall certify to the governor, the temporary president of the senate,
23 the speaker of the assembly, the chair of the senate finance committee,
24 and the chair of the assembly ways and means committee the amount of
25 money deposited in the firearm violence's research fund during the
26 preceding calendar year as the result of revenue derived pursuant to
27 section six hundred thirty-i of the tax law, as amended by chapter 169
28 of the laws of 2022.
29 7. (a) On or before the first day of February each year, the executive
30 committee of the New York firearm violence research institute shall
31 provide a written report to the governor, the temporary president of the
32 senate, the speaker of the assembly, the chair of the senate finance
33 committee, the chair of the assembly ways and means committee, the chair
34 of the senate committee on health, the chair of the assembly health
35 committee, the state comptroller, and the public. Such report shall
36 include how the monies of the fund were utilized during the preceding
37 calendar year, and shall include:
38 (i) the amount of money disbursed from the fund and the award process
39 used for such disbursements;
40 (ii) recipients of awards from the fund and how such recipients were
41 selected;
42 (iii) the amount awarded to each recipient;
43 (iv) the purposes for which such awards were granted;
44 (v) a summary financial plan for such monies which shall include esti-
45 mates of all receipts and all disbursements for the current and succeed-
46 ing fiscal years, along with the actual results from the prior fiscal
47 year; and
48 (vi) an explanation of why any remaining funds were not utilized, if
49 applicable.
50 (b) Such report shall be made available to the public on the New York
51 firearm violence research institute's website. Should a report not be
52 made available by the first day of February each year, the office shall
53 update its website to inform the public that such report is not yet
54 available and provide an expected release date.

1 8. To the extent practicable, the commissioner of health shall ensure
2 that all monies received during a fiscal year are expended prior to the
3 end of that fiscal year.
4 § 9. Section 97-yyyy of the state finance law is amended by adding
5 three new subdivisions 4, 5 and 6 to read as follows:
6 4. On or before the first day of February each year, the comptroller
7 shall certify to the governor, the temporary president of the senate,
8 the speaker of the assembly, the chair of the senate finance committee,
9 and the chair of the assembly ways and means committee the amount of
10 money deposited in the New York state council on the arts' fund during
11 the preceding calendar year as the result of revenue derived pursuant to
12 section six hundred thirty-g of the tax law, as added by chapter 267 of
13 the laws of 2019.
14 5. (a) On or before the first day of February each year, the New York
15 state council on the arts shall provide a written report to the gover-
16 nor, the temporary president of the senate, the speaker of the assembly,
17 the chair of the senate finance committee, the chair of the assembly
18 ways and means committee, the chair of the senate committee on health,
19 the chair of the assembly health committee, the state comptroller, and
20 the public. Such report shall include how the monies of the fund were
21 utilized during the preceding calendar year, and shall include:
22 (i) the amount of money disbursed from the fund and the award process
23 used for such disbursements;
24 (ii) recipients of awards from the fund and how such recipients were
25 selected;
26 (iii) the amount awarded to each recipient;
27 (iv) the purposes for which such awards were granted;
28 (v) a summary financial plan for such monies which shall include esti-
29 mates of all receipts and all disbursements for the current and succeed-
30 ing fiscal years, along with the actual results from the prior fiscal
31 year; and
32 (vi) an explanation of why any remaining funds were not utilized, if
33 applicable.
34 (b) Such report shall be made available to the public on the New York
35 state council on the arts' website. Should a report not be made avail-
36 able by the first day of February each year, the council shall update
37 its website to inform the public that such report is not yet available
38 and provide an expected release date.
39 6. To the extent practicable, the New York state council on the arts
40 shall ensure that all monies received during a fiscal year are expended
41 prior to the end of that fiscal year.
42 § 10. Subdivision 6 of section 82 of the state finance law, as amended
43 by section 1 of part Q of chapter 56 of the laws of 2021, is amended and
44 a new subdivision 7 is added to read as follows:
45 6. (a) On or before the first day of February each year, the commis-
46 sioner of health shall provide a written report to the governor, the
47 temporary president of the senate, the speaker of the assembly, the
48 chair of the senate finance committee, the chair of the assembly ways
49 and means committee, the chair of the senate committee on social
50 services, the chair of the assembly social services committee, and the
51 public. Such report shall include how the monies of the fund were
52 utilized during the preceding calendar year and shall include:
53 [(a)] (i) the amount of money disbursed from the fund;
54 [(b)] (ii) the recipients of awards from the fund and how such recipi-
55 ents were selected;
56 [(c)] (iii) the amount awarded to each recipient;

1 [(d)] (iv) the purposes for which such awards were granted; [and]
2 [(e)] (v) a summary financial plan for such monies which shall include
3 estimates of all receipts and all disbursements for the current and
4 succeeding fiscal years, along with the actual results from the prior
5 fiscal year; and
6 (vi) an explanation of why any remaining funds were not utilized, if
7 applicable.
8 (b) Such report shall be made available to the public on the depart-
9 ment of health's website. Should a report not be made available by the
10 first day of February each year, the department shall update its website
11 to inform the public that such report is not yet available and provide
12 an expected release date.
13 7. To the extent practicable, the department shall ensure that all
14 monies received during a fiscal year are expended prior to the end of
15 that fiscal year.
16 § 11. Subdivision 7 of section 91-g of the state finance law, as added
17 by chapter 659 of the laws of 2019, is amended to read as follows:
18 7. (a) On or before the first day of February each year, the director
19 of the state office for the aging shall provide a written report to the
20 governor, the temporary president of the senate, the speaker of the
21 assembly, the chair of the senate finance committee, the chair of the
22 assembly ways and means committee, the chair of the senate committee on
23 aging, and the chair of the assembly aging committee. Such report shall
24 include how the monies of the fund were utilized during the preceding
25 calendar year and shall include:
26 (i) the amount of money dispersed from the fund and the award process
27 used for such disbursements;
28 (ii) recipients of awards from the fund and how much recipients were
29 selected;
30 (iii) the amount awarded to each; [and]
31 (iv) the purposes for which such awards were granted;
32 (v) a summary financial plan for such monies which shall include esti-
33 mates of all receipts and all disbursements for the current and succeed-
34 ing fiscal years, along with the actual results from the prior fiscal
35 year; and
36 (vi) an explanation of why any remaining funds were not utilized, if
37 applicable.
38 (b) Such report shall be made available to the public on the office
39 for the aging's website. Should a report not be made available by the
40 first day of February each year, the office shall update its website to
41 inform the public that such report is not yet available and provide an
42 expected release date.
43 § 12. Subdivision 2-a of section 99-v of the state finance law, as
44 added by chapter 453 of the laws of 2015, the opening paragraph as
45 amended by section 23 of part PP of chapter 56 of the laws of 2022, is
46 amended and a new subdivision 6 is added to read as follows:
47 2-a. (a) On or before the first day of February each year, the commis-
48 sioner of the New York state department of veterans' services shall
49 provide a written report to the governor, the temporary president of the
50 senate, the speaker of the assembly, the chair of the senate finance
51 committee, the chair of the assembly ways and means committee, the chair
52 of the senate committee on veterans, homeland security and military
53 affairs, the chair of the assembly veterans' affairs committee, the
54 state comptroller, and the public. Such report shall include how the
55 monies of the fund were utilized during the preceding calendar year, and
56 shall include:

1 (i) the amount of money dispersed from the fund and the award process
2 used for such disbursements;
3 (ii) recipients of awards from the fund and how such recipients were
4 selected;
5 (iii) the amount awarded to each recipient;
6 (iv) the purposes for which such awards were granted; [and]
7 (v) a summary financial plan for such monies which shall include esti-
8 mates of all receipts and all disbursements for the current and succeed-
9 ing fiscal years, along with the actual results from the prior fiscal
10 year; and
11 (vi) an explanation of why any remaining funds were not utilized, if
12 applicable.
13 (b) Such report shall be made available to the public on the New York
14 state department of veterans' services' website. Should a report not be
15 made available by the first day of February each year, the department
16 shall update its website to inform the public that such report is not
17 yet available and provide an expected release date.
18 6. To the extent practicable, the director of the state department of
19 veterans' services shall ensure that all monies received during a fiscal
20 year are expended prior to the end of such fiscal year.
21 § 13. Subdivision 2-a of section 84 of the state finance law, as added
22 by chapter 453 of the laws of 2015, the opening paragraph as amended by
23 section 27-b of part UU of chapter 54 of the laws of 2016, is amended
24 and a new subdivision 4 is added to read as follows:
25 2-a. (a) On or before the first day of February of each calendar year,
26 the comptroller shall certify to the governor, the temporary president
27 of the senate, the speaker of the assembly, the chair of the senate
28 finance committee, and the chair of the assembly ways and means commit-
29 tee the amount of money deposited in the United States Olympic
30 Committee/Lake Placid Olympic Training Center fund during the preceding
31 calendar year as the result of revenue derived pursuant to section six
32 hundred twenty-six of the tax law, and from all grants, gifts and
33 bequests.
34 (b) On or before the first day of February each year, the chairperson
35 of the New York state Olympic regional development authority shall
36 provide a written report to the governor, the temporary president of the
37 senate, the speaker of the assembly, the chair of the senate finance
38 committee, the chair of the assembly ways and means committee, the chair
39 of the senate committee on cultural affairs, tourism, parks and recre-
40 ation, the chair of the assembly tourism, parks, arts and sports devel-
41 opment committee, the state comptroller, and the public. Such report
42 shall include how the monies of the fund were utilized during the
43 preceding calendar year, and shall include:
44 (i) the amount of money dispersed from the fund and the award process
45 used for such disbursements;
46 (ii) recipients of awards from the fund and how such recipients were
47 selected;
48 (iii) the amount awarded to each;
49 (iv) the purposes for which such awards were granted; [and]
50 (v) a summary financial plan for such monies which shall include esti-
51 mates of all receipts and all disbursements for the current and succeed-
52 ing fiscal years, along with the actual results from the prior fiscal
53 year; and
54 (vi) an explanation of why any remaining funds were not utilized, if
55 applicable.

1 (c) Such report shall be made available to the public on the New York
2 state Olympic regional development authority's website. Should a report
3 not be made available by the first day of February each year, the
4 authority shall update its website to inform the public that such report
5 is not yet available and provide an expected release date.
6 4. To the extent practicable, the chairperson of the New York state
7 Olympic regional development authority shall ensure that all monies
8 received during a fiscal year are expended prior to the end of such
9 fiscal year.
10 § 14. Subdivisions 2, 2-a, and 3 of section 99-l of the state finance
11 law, subdivision 2 as amended and subdivision 2-a as added by chapter
12 174 of the laws of 2017, and subdivision 3 as added by chapter 303 of
13 the laws of 2004, are amended to read as follows:
14 2. (a) Such fund shall consist of all revenues received by the depart-
15 ment of motor vehicles pursuant to section four hundred four-v of the
16 vehicle and traffic law, as added by chapter three hundred three of the
17 laws of two thousand four, all the revenues received by the department
18 of taxation and finance pursuant to sections two hundred nine-K and six
19 hundred thirty-e of the tax law and all other moneys appropriated, cred-
20 ited, or transferred thereto from any other fund or source pursuant to
21 law.
22 (b) On or before the first day of February of each calendar year, the
23 comptroller shall certify to the governor, the temporary president of
24 the senate, the speaker of the assembly, the chair of the senate finance
25 committee, and the chair of the assembly ways and means committee the
26 amount of money deposited in the love your library fund during the
27 preceding calendar year as the result of revenue derived pursuant to
28 section six hundred thirty-e of the tax law, and from all grants, gifts
29 and bequests.
30 2-a. (a) On or before the first day of February each year, the commis-
31 sioner of the department of education shall provide a written report to
32 the governor, the temporary president of the senate, the speaker of the
33 assembly, the chair of the senate finance committee, the chair of the
34 assembly ways and means committee, the state comptroller, and the
35 public. Such report shall include how the monies of the fund were
36 utilized during the preceding calendar year, and shall include:
37 (i) the amount of money disbursed from the fund and the award process
38 used for such disbursements;
39 (ii) recipients of awards from the fund and how such recipients were
40 selected;
41 (iii) the amount awarded to each recipient;
42 (iv) the purposes for which such awards were granted; [and]
43 (v) a summary financial plan for such monies which shall include esti-
44 mates of all receipts and all disbursements for the current and succeed-
45 ing fiscal years, along with the actual results from the prior fiscal
46 year; and
47 (vi) an explanation of why any remaining funds were not utilized, if
48 applicable.
49 (b) Such report shall be made available to the public on the New York
50 state department of education's website. Should a report not be made
51 available by the first day of February each year, the department shall
52 update its website to inform the public that such report is not yet
53 available and provide an expected release date.
54 3. (a) Moneys of the fund, following appropriation by the legislature
55 shall be expended only for the purposes of providing funding for the
56 statewide summer reading program set forth in subdivision ten of section

1 two hundred seventy-three of the education law. Moneys shall be paid out
2 of the fund on the audit and warrant of the state comptroller on vouch-
3 ers approved and certified by the commissioner of education. Any inter-
4 est received by the comptroller on moneys on deposit in the love your
5 library fund shall be retained in and become part of such fund.
6 (b) To the extent practicable, the commissioner of education shall
7 ensure that all monies received during a fiscal year are expended prior
8 to the end of such fiscal year.
9 § 15. Subdivision 2-b of section 97-pppp of the state finance law, as
10 added by chapter 374 of the laws of 2017, is amended to read as follows:
11 2-b. (a) On or before the first day of February each year, the commis-
12 sioner of health shall provide a written report to the governor, the
13 temporary president of the senate, the speaker of the assembly, the
14 chair of the senate finance committee, the chair of the assembly ways
15 and means committee, the chair of the senate committee on health, the
16 chair of the assembly health committee, the state comptroller, and the
17 public. Such report shall include how the monies of the fund were

34 its website to inform the public that such report is not yet available
35 and provide an expected release date.
36 § 16. Subdivision 4 of section 95-h of the state finance law, as added
37 by chapter 422 of the laws of 2015, is amended to read as follows:
38 4. (a) The monies of the fund shall be paid out on the audit and
39 warrant of the state comptroller on vouchers certified or approved by
40 the commissioner of mental health, or by an officer or employee of the
41 office of mental health designated by such commissioner.
42 (b) On or before the first day of February each year, the comptroller
43 shall certify to the governor, the temporary president of the senate,
44 the speaker of the assembly, the chair of the senate finance committee,
45 and the chair of the assembly ways and means committee the amount of
46 money deposited in the mental illness anti-stigma fund during the
47 preceding calendar year as the result of revenue derived pursuant to
48 section six hundred twenty-nine-a of the tax law.
49 (c) On or before the first day of February each year, the commissioner
50 of mental health shall provide a written report to the governor, the
51 temporary president of the senate, the speaker of the assembly, the
52 chair of the senate finance committee, the chair of the assembly ways
53 and means committee, the chair of the senate committee on health, the
54 chair of the assembly health committee, the state comptroller, and the
55 public. Such report shall include how the monies of the fund were
56 utilized during the preceding calendar year, and shall include:

14 state department of mental hygiene's website. Should a report not be
15 made available by the first day of February each year, the department
16 shall update its website to inform the public that such report is not
17 yet available and provide an expected release date.
18 (e) To the extent practicable, the department of mental hygiene shall
19 ensure that all monies received during a fiscal year are expended prior
20 to the end of that fiscal year.
21 § 17. Subdivision 7 of section 89-i of the state finance law, as added
22 by chapter 374 of the laws of 2018, is amended to read as follows:
23 7. (a) On or before the first day of February each year, the New York
24 state director of veterans' affairs shall provide a written report to
25 the governor, the temporary president of the senate, the speaker of the
26 assembly, the chair of the senate finance committee, the chair of the
27 assembly ways and means committee, the chair of the senate committee on
28 veterans, homeland security and military affairs, the chair of the
29 assembly veterans affairs committee, and the public. Such report shall
30 include how the monies of the fund were utilized during the preceding
31 calendar year and shall include:
32 (i) the amount of money dispersed from the fund;
33 (ii) the recipients of awards from the fund and how such recipients
34 were selected;
35 (iii) the amount awarded to each recipient;
36 (iv) the purposes for which such awards were granted; [and]
37 (v) a summary financial plan for such monies which shall include esti-
38 mates of all receipts and all disbursements for the current and succeed-
39 ing fiscal years, along with the actual results from the prior fiscal
40 year; and
41 (vi) an explanation of why any remaining funds were not utilized, if
42 applicable.
43 (b) Such report shall be made available to the public on the New York
44 state department of veterans' affairs' website. Should a report not be
45 made available by the first day of February each year, the department
46 shall update its website to inform the public that such report is not

48 § 18. Subdivisions 2-a and 5 of section 95-d of the state finance law,
49 subdivision 2-a as added by chapter 215 of the laws of 2018, and subdi-
50 vision 5 as added by chapter 415 of the laws of 2003, are amended to
51 read as follows:

24 money deposited in the life pass it on trust fund during the preceding
25 calendar year as the result of revenue derived pursuant to section four
26 hundred four-u of the vehicle and traffic law, as added by chapter 415
27 of the laws of 2003.
28 § 19. Paragraph (b) of subdivision 4 and subdivision 5 of section 95-e
29 of the state finance law, paragraph (b) of subdivision 4 as amended by
30 chapter 453 of the laws of 2015, and subdivision 5 as amended by section
31 7 of part A of chapter 60 of the laws of 2014, are amended and a new
32 paragraph (c) is added to subdivision 4 to read as follows:
33 (b) On or before the first day of February each year, the commissioner
34 of health shall provide a written report to the governor, the temporary
35 president of the senate, the speaker of the assembly, the chair of the

3 5. (a) Moneys shall be payable from the fund on the audit and warrant
4 of the comptroller on vouchers approved by the comptroller.
5 (b) To the extent practicable, the commissioner of health shall ensure
6 that all monies received during a fiscal year are expended prior to the
7 end of that fiscal year.
8 § 20. Paragraph 1-a of subdivision (a) of section 83 of the state
9 finance law, as added by chapter 453 of the laws of 2015, and the open-
10 ing paragraph of paragraph 1-a as amended by section 27-a of part UU of
11 chapter 54 of the laws of 2016, is amended to read as follows:
12 1-a. (i) On or before the first day of February each year, the commis-
13 sioner of the department of environmental conservation shall provide a
14 written report to the governor, the temporary president of the senate,
15 the speaker of the assembly, the chair of the senate finance committee,
16 the chair of the assembly ways and means committee, the chair of the
17 senate committee on environmental conservation, the chair of the assem-
18 bly environmental conservation committee, the state comptroller, and the
19 public. Such report shall include how the monies of the fund received
20 pursuant to section six hundred twenty-five of the tax law were utilized
21 during the preceding calendar year, and shall include:
22 [(i)] (1) the amount of money dispersed from the fund and the award
23 process used for such disbursements;
24 [(ii)] (2) recipients of awards from the fund and how such recipients
25 were selected;
26 [(iii)] (3) the amount awarded to each recipient;
27 [(iv)] (4) the purposes for which such awards were granted; [and
28 (v)] (5) a summary financial plan for such monies which shall include
29 estimates of all receipts and all disbursements for the current and
30 succeeding fiscal years, along with the actual results from the prior
31 fiscal year; and
32 (6) an explanation of why any remaining funds were not utilized, if
33 applicable.

20 employee of the office of addiction services and supports designated by
21 such commissioner.
22 (b) On or before the first day of February each year, the comptroller
23 shall certify to the governor, the temporary president of the senate,
24 the speaker of the assembly, the chair of the senate finance committee,
25 and the chair of the assembly ways and means committee the amount of
26 money deposited by source in the substance use disorder education and
27 recovery fund during the preceding calendar year as the result of reven-
28 ue derived pursuant to section six hundred twenty-nine-b of the tax law.
29 (c) On or before the first day of February each year, the commissioner
30 of addiction services shall provide a written report to the governor,
31 the temporary president of the senate, the speaker of the assembly, the
32 chair of the senate finance committee, the chair of the assembly ways
33 and means committee, the chair of the senate committee on health, the
34 chair of the assembly health committee, the state comptroller, and the
35 public. Such report shall include how monies of the fund were utilized
36 during the preceding calendar year and shall include:
37 (i) the amount of money disbursed from the fund and the award process
38 used for such disbursements;
39 (ii) recipients of awards from the fund and how such recipients were
40 selected;
41 (iii) the amount awarded to each recipient;
42 (iv) the purposes for which such awards were granted;
43 (v) a summary financial plan for such monies which shall include esti-
44 mates of all receipts and all disbursements for the current and succeed-
45 ing fiscal years, along with the actual results from the prior fiscal
46 year; and
47 (vi) an explanation of why any remaining funds were not utilized, if
48 applicable.
49 (d) Such report shall be made available to the public on the New York
50 state office of addiction services and supports website. Should a report
51 not be made available by the first day of February each year, the
52 department shall update its website to inform the public that such

54 § 23. Subdivisions 2 and 2-a of section 99-u of the state finance law,
55 as amended by section 31 of part A of chapter 54 of the laws of 2016,
56 are amended to read as follows:

1 2. (a) Such fund shall consist of all revenues received by the depart-
2 ment of taxation and finance, pursuant to the provisions of section six
3 hundred thirty-c of the tax law and all other moneys appropriated there-
4 to from any other fund or source pursuant to law. Nothing contained in
5 this section shall prevent the state from receiving grants, gifts or
6 bequests for the purposes of the fund as defined in this section and
7 depositing them into the fund according to law.
8 (b) On or before the first day of February each year, the comptroller
9 shall certify to the governor, the temporary president of the senate,
10 the speaker of the assembly, the chair of the senate finance committee,
11 and the chair of the assembly ways and means committee the amount of
12 money deposited by source in the New York state teen health education
13 fund during the preceding calendar year as the result of revenue derived

26 § 27. Subdivision 5 of section 97-llll of the state finance law, as
27 added by chapter 420 of the laws of 2015, is amended to read as follows:

8 § 28. This act shall take effect immediately.
