AN ACT directing the public service commission to modify the objectives
of the Clean Energy Fund for reductions of air pollution including
oxides of nitrogen, sulfur dioxide and particulate matter, and relat-
ing to the value of distributed energy resources
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Within one hundred eighty days of the effective date of
2 this act, the public service commission shall modify the stated objec-
3 tives of the Clean Energy Fund established by the January 21, 2016 order
4 of the commission in case 14-M-0094 for reductions of air pollution
5 including oxides of nitrogen, sulfur dioxide, and particulate matter, as
6 measured in tons of pollution reduced.
7 § 2. Within one hundred twenty days of the effective date of this act
8 the public service commission shall, in consultation with the department
9 of environmental conservation, establish appropriate compensation under
10 the "Value Stack", as adopted by the commission in case 15-E-0751, for
11 reductions of air pollution including oxides of nitrogen, sulfur diox-
12 ide, and particulate matter.
13 § 3. Within one hundred eighty days of the effective date of this act,
14 the Long Island power authority shall establish appropriate compensation
15 under the "Value Stack", as adopted in the authority's Value of Distrib-
16 uted Energy Resources tariff, for reduction of air pollution including
17 oxides of nitrogen, sulfur dioxide, and particulate matter.
18 § 4. This act shall take effect immediately.
