ZACCARO -- read once and referred to the Commit- tee on Governmental Operations AN ACT to amend the executive law, in relation to fire-resistant materi- al applicator training The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 155-a of the executive law is amended by adding two 2 new subdivisions 6 and 7 to read as follows: 3 6. "Fire-resistant material" shall mean cementitious or fibrous mate- 4 rials that are sprayed onto a surface to provide fire-resistant 5 protection of the substrate. 6 7. "Fire-resistant material applicator" shall mean an individual who 7 applies fire-resistant material. 8 § 2. The executive law is amended by adding a new section 159-b to 9 read as follows: 10 § 159-b. Fire-resistant material applicators training. 1. The state 11 fire administrator shall develop and conduct a training program for 12 fire-resistant material applicators. The state fire administrator shall 13 promulgate rules and regulations including, but not limited to: 14 (a) Minimum courses of study, informed by manufacturer specifications, 15 and attendance and registration requirements for such training program; 16 and 17 (b) Requirements to be eligible and receive a certification upon 18 completion of such training program. 19 2. Every fire-resistant material applicator shall complete such train- 20 ing and obtain a certification. 21 3. Any person applying fire-resistant material who does not receive 22 the training and obtain a certification as required by subdivision two 23 of this section shall be fined not more than two hundred fifty dollars 24 for each violation. 25 § 3.
