        AN ACT to amend  the  local  emergency  housing  rent  control  act,  in
          relation  to the date in calendar year 2022 when the local legislative
          body of a city having a population of one million or more  may  deter-
          mine  the  continuation of the emergency; and providing for the repeal
          of such provisions upon the expiration thereof
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  Subdivision  3  of section 1 of chapter 21 of the laws of
     2  1962, constituting the local emergency  housing  rent  control  act,  as
     3  amended  by  section  1  of part U of chapter 56 of the laws of 2020, is
     4  amended to read as follows:
     5    3. Local determination as to continuation of emergency. The  continua-
     6  tion,  after  May  thirty-first,  nineteen  hundred  sixty-seven, of the
     7  public emergency requiring the regulation  and  control  of  residential
     8  rents  and evictions within cities having a population of one million or
     9  more shall be a matter for local determination within  each  such  city.
    10  Any  such  determination  shall be made by the local legislative body of
    11  such city on or before April first, nineteen hundred sixty-seven and  at
    12  least  once  in every third year thereafter following a survey which the
    13  city shall cause to be made of  the  supply  of  housing  accommodations
    14  within  such city, the condition of such accommodations and the need for
    15  continuing the regulation and control of residential rents and evictions
    16  within such city, provided, however, that when the date  by  which  such
    17  determination shall be made falls in a calendar year immediately follow-
    18  ing  a  calendar  year  during  which  a  federal  decennial  census  is
    19  conducted, such date shall be  postponed  by  one  year,  and  provided,
    20  further,  that  to ensure sufficient time to complete such survey in the
    21  context of the COVID-19 pandemic, the date by which  such  determination
    22  shall  be made by the local legislative body in calendar year 2022 shall

     1  be postponed until July 1, 2022. Such survey shall be submitted to  such
     2  legislative  body not less than thirty nor more than sixty days prior to
     3  the date of any such determination.
     4    §  2.  This  act shall take effect immediately and shall expire and be
     5  deemed repealed on December 31, 2023, provided that such expiration  and
     6  repeal  shall  not  affect  the validity of any determination consistent
     7  with this act made in calendar year 2022.
