        AN  ACT  providing  for  a grace period in which former employees of the
          department of corrections and community supervision that  participated
          in  a  strike may return to work; and providing for the repeal of such
          provisions upon expiration thereof
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section 1. 1. Any employee of the department of corrections and commu-
     2  nity  supervision who engaged in a strike or work stoppage on or between
     3  the dates of February 18, 2025, and the  effective  date  of  this  act,
     4  shall  be  allowed to be reinstated and return to work on their assigned
     5  tour by July 1, 2025. For any department of  corrections  and  community
     6  supervision  employee  who  participated  in  a  voluntary work stoppage
     7  between February 18, 2025, and  the  effective  date  of  this  act  and
     8  returns  to  work  before  July  1, 2025, there shall be no disciplinary
     9  action or demotion of rank.  Any department of corrections and community
    10  supervision employee who resigned between February  18,  2025,  and  the
    11  effective  date  of  this act shall be allowed full reinstatement to the
    12  department of corrections and community supervision and will be  allowed
    13  to  return  to  full  duty without discipline. Any employee who has been
    14  terminated or received termination notice shall be returned to full duty
    15  without discipline and shall be reinstated to the status they maintained
    16  on or before February 18, 2025.
    17    2. No department of corrections and community supervision employee  on
    18  pre-approved  leave for family medical leave, workers compensation, paid
    19  parental leave, long term sick leave,  bereavement,  or  sick  leave  at
    20  half-pay,  shall be ordered to prematurely return to work between Febru-

     1  ary 18, 2025 and July 1, 2025. The provisions of this subdivision  shall
     2  not apply to vacation or personal leave.
     3    §  2.  This  act shall take effect immediately and shall expire and be
     4  deemed repealed July 1, 2025.
