        AN ACT to amend the elder law, in relation to requiring the commissioner
          of health to produce a report on the utilization and activity  of  the
          elderly pharmaceutical insurance coverage program

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. The elder law is amended by adding a  new  section  255  to
     2  read as follows:
     3    §  255.  Report on the utilization and activity of the elderly pharma-
     4  ceutical insurance coverage program. 1. The commissioner of health shall
     5  produce a report on the utilization and activity of the elderly  pharma-
     6  ceutical  insurance coverage program. Such report shall include, but not
     7  be limited to, the following statistical information  for  each  program
     8  year from two thousand twenty-two through two thousand twenty-six:
     9    (a)  the  number of persons enrolled in the program by marital status,
    10  income level, and age;
    11    (b) the total number  of  enrollees  that  receive  an  income-related
    12  subsidy under section 1860D-14 of the federal social security act;
    13    (c)  the  number of enrollees that qualify through their enrollment in
    14  the medicare savings program; distribution of claims by pharmacy type;
    15    (d) the number of participating provider pharmacies,  recipients,  and
    16  payments by county;
    17    (e)  a  summary  of  the  administrative  cost containment initiatives
    18  completed during the year; and
    19    (f) an evaluation of the performance  of  the  program  contractor  or
    20  contractors and of the cost effectiveness of all outreach efforts.
    21    2.  The  report shall also include enrollment and program cost projec-
    22  tions for the two thousand twenty-seven and  two  thousand  twenty-eight
    23  program years.

     1    3.  The  report shall be published on the department of health website
     2  and delivered to the governor, the temporary president  of  the  senate,
     3  and  the  speaker of the assembly, by January thirty-first, two thousand
     4  twenty-seven.
     5    § 2. This act shall take effect immediately.
