        AN ACT to amend the education law, in relation to authorizing the appli-
          cation of topical fluoride varnish to a child's teeth by a  parent  or
          legal guardian
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Section 6610 of the education law is amended  by  adding  a
     2  new subdivision 9 to read as follows:
     3    9.  The  application of topical fluoride varnish to a child's teeth by
     4  such child's parent or legal guardian, provided that such application is
     5  done under the direction and  supervision  of  a  licensed  practitioner
     6  authorized  to  apply  topical fluoride varnish. A licensed practitioner
     7  acting within their scope of practice  may  prescribe  topical  fluoride
     8  varnish  for the purposes of this subdivision provided that such practi-
     9  tioner dispenses written safety instructions  to  the  parent  or  legal
    10  guardian.
    11    § 2. This act shall take effect immediately.
