AN ACT to amend the general business law, in relation to banning push
notifications from fast food mobile applications to minors
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The general business law is amended by adding a new section
2 390-f to read as follows:
3 § 390-f. Push notifications from fast food mobile applications to
4 minors. 1. Any mobile application or mobile platform, operated by, oper-
5 ated on behalf of, or owned by any fast-food establishment, shall
6 require an individual to manually enter the individual's date of birth
7 when registering for an account with such platform or application.
8 2. Any mobile application or mobile platform which is operated by,
9 operated on behalf of, or owned by any fast-food establishment shall be
10 prohibited from initiating or sending mobile device push notifications
11 or text message notifications, including alerts, designed to encourage
12 an individual to engage with such application or platform, where such
13 individual has registered for an account with a date of birth which
14 indicate that such person is a minor.
15 3. For purposes of this section:
16 (a) Push notification means an automatic electronic message displayed
17 on a mobile device, when the user interface for a fast-food establish-
18 ment's platform or application is not actively open or visible on the
19 device, that prompts the account holder to check or engage with such a
20 platform or application.
21 (b) Minor means an individual under the age of eighteen.
22 § 2. This act shall take effect immediately.
