BRONSON -- read once and referred to the Commit- tee on Health AN ACT to amend the public health law and the social services law, in relation to allowing personal caregivers to visit residents of adult care facilities The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivision 2 of section 2801-h of the public health law, 2 as amended by chapter 108 of the laws of 2021, is amended to read as 3 follows: 4 2. [During a public health emergency declared under section twenty-5four or section twenty-eight of the executive law personal] Personal 6 caregiving visitors may visit residents of nursing homes, in compliance 7 with federal law and regulations and state regulations made under this 8 section. Nursing homes shall admit any personal caregiving visitor who 9 is in compliance with applicable requirements under this section. 10 § 2. Subdivision 2 of section 461-u of the social services law, as 11 amended by chapter 108 of the laws of 2021, is amended to read as 12 follows: 13 2. [During a public health emergency declared under section twenty-14four or section twenty-eight of the executive law personal] Personal 15 caregiving visitors may visit residents of adult care facilities, in 16 compliance with federal law and regulations and state regulations made 17 under this section. Adult care facilities shall admit any personal care- 18 giving visitor who is in compliance with applicable requirements under 19 this section. 20 § 3. This act shall take effect immediately.
