KIM -- read once and referred to the Committee on Aging AN ACT to amend the elder law, in relation to the naturally occurring retirement community supportive service program The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 1 of a chapter of the laws of 2023 amending the 2 elder law relating to the naturally occurring retirement community 3 supportive service program, as proposed in legislative bills numbers S. 4 5907 and A. 5520, is amended to read as follows: 5 Section 1. The state office for the aging is authorized and directed 6 to conduct a study on the number of older adults residing in naturally 7 occurring retirement communities or neighborhood naturally occurring 8 retirement communities who are suffering from social isolation and lone- 9 liness. Such study shall include, but not be limited to the number of 10 members of such communities suffering from social isolation or loneli- 11 ness based on data collected from those residents participating in 12 programs or services provided under section 209 of the elder law, 13 current programs or services seeking to alleviate these conditions, and 14 additional programs or services that could be implemented. 15 § 2. Subdivision 8 of section 209 of the elder law, as amended by a 16 chapter of the laws of 2023 amending the elder law relating to the 17 naturally occurring retirement community supportive service program, as 18 proposed in legislative bills numbers S. 5907 and A. 5520, is amended to 19 read as follows: 20 8. On or before March first, two thousand nineteen, and every five 21 years thereafter, the director shall report to the governor and the 22 finance committee of the senate and the ways and means committee of the 23 assembly concerning the effectiveness of the naturally occurring retire- 24 ment community supportive services program in achieving the objectives 25 set forth by this section, which include helping to address the needs of 26 residents in such classic and neighborhood naturally occurring retire- 27 ment communities, assuring access to a continuum of necessary services, 28 increasing private, philanthropic and other public funding for programs, EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. The report 2 shall also include recommendations concerning continuation or modifica- 3 tion of the program from the director. The director shall provide the 4 required information and any other information deemed appropriate to the 5 report in such form and detail as will be helpful to the legislature and 6 the governor in determining to extend, eliminate or modify the program 7 including, but not limited to, the following: 8 (a) the number, size, type and location of the projects developed and 9 funded, including the number, kinds and functions of staff in each 10 program; 11 (b) the age, sex, religion and other appropriate demographic informa- 12 tion concerning the residents served; 13 (c) the services provided to residents, reported in such manner as to 14 allow comparison of services by demographic group and region; 15 (d) a listing of the services provided by eligible applicants, includ- 16 ing the number, kind and intensity of such services; 17 (e) a listing of partner organizations providing services, the number, 18 kind and intensity of such services, and, to the extent practicable, the 19 outcomes of such referrals; and 20 (f) the number of residents participating in programs or services 21 provided under this section who [are] report suffering from social 22 isolation and loneliness and the services provided to residents. 23 § 3. Section 4 of a chapter of the laws of 2023 amending the elder law 24 relating to the naturally occurring retirement community supportive 25 service program, as proposed in legislative bills numbers S. 5907 and A. 26 5520, is amended to read as follows: 27 § 4. This act shall take effect [immediately] September 1, 2024; 28 provided, however, that the provisions of sections one and two of this 29 act shall expire and be deemed repealed on the thirtieth day after the 30 delivery of the report to the governor and the legislature as provided 31 for in section two of this act; provided, further, that the state office 32 for the aging shall notify the legislative bill drafting commission upon 33 the delivery of the report provided for in section two of this act in 34 order that the commission may maintain an accurate and timely effective 35 data base of the official text of the laws of the state of New York in 36 furtherance of effectuating the provisions of section 44 of the legisla- 37 tive law and section 70-b of the public officers law. 38 § 4. This act shall take effect immediately; provided, however, 39 sections one and two of this act shall take effect on the same date and 40 in the same manner as a chapter of the laws of 2023 amending the elder 41 law relating to the naturally occurring retirement community supportive 42 service program, as proposed in legislative bills numbers S. 5907 and A. 43 5520, takes effect.
