        AN ACT to amend the military law, in relation to covered operations with
          regard to certain calculations of compensation
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  Subparagraph  (v)  of paragraph (a) of subdivision 5-a of
     2  section 242 of the military law, as added by chapter 238 of the laws  of
     3  2008, is amended to read as follows:
     4    (v)  "Covered operation" means those military operations designated as
     5  active military, naval, air, or space service by the federal  government
     6  of  the  United  States[,  in  support  of "Operation Enduring Freedom",
     7  "Operation Iraqi Freedom", "Operation Noble Eagle", or successors there-
     8  to, or operations specifically connected by federal designation,  action
     9  or implication with homeland security] or the state of New York, defined
    10  as  active  service  under 10 USC § 101 (d)(3).  The implementing agency
    11  may make such additional designations on  a  case-by-case  basis  as  it
    12  shall  deem,  in  its  discretion,  to be in keeping with the spirit and
    13  intent of this subdivision.
    14    § 2. This act shall take effect immediately.
