Directs school districts to establish parent advisory councils on special education to advise on matters that pertain to the education and safety of students with disabilities, and meet regularly with school officials to participate in the planning, development, and evaluation of the school district's special education programs.

AN ACT to amend the education law, in relation to directing school
districts to establish parent advisory councils on special education
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 4402 of the education law is amended by adding a
2 new subdivision 10 to read as follows:
3 10. The board of education or trustees of each school district shall
4 establish a parent advisory council on special education. Membership of
5 such council shall be offered to all parents of children with disabili-
6 ties in the school district and other interested parties. The parent
7 advisory councils' duties shall include, but not be limited to, advising
8 the board of education or trustees of the school district on matters
9 that pertain to the education and safety of students with disabilities,
10 and meeting regularly with school officials to participate in the plan-
11 ning, development, and evaluation of the school district's special
12 education programs. Parent advisory councils shall establish by-laws
13 regarding officers and operational procedures. In the course of its
14 duties under this section, a parent advisory council shall receive
15 assistance from the board of education or trustees without charge, upon
16 reasonable notice, and subject to the availability of staff and
17 resources.
18 § 2. This act shall take effect immediately.
