AN ACT to amend the general business law, in relation to imposing fines
on businesses which are found to have card skimmers operating at such
business
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The general business law is amended by adding a new section
2 390-f to read as follows:
3 § 390-f. Skimming prevention. 1. For the purposes of this section, the
4 term "skimming" shall be defined as obtaining a consumer's personal
5 identifying information as defined in subdivision one of section 190.77
6 of the penal law through the use of a skimmer device as defined in
7 subdivision two of section 190.85 of the penal law.
8 2. Whenever a skimming device is installed at a place of business for
9 more than one hour and skimming occurs, the person, firm, partnership,
10 association or corporation who performed sales transactions which
11 resulted in skimming occurring shall be assessed a civil penalty not to
12 exceed ten thousand dollars per hour the skimming device was installed.
13 § 2. This act shall take effect on the thirtieth day after it shall
14 have become a law.
