AN ACT to amend the executive law, in relation to terms and conditions
of employment for members of the collective negotiating unit consist-
ing of investigators, senior investigators, and investigative special-
ists in the division of state police; to amend the state finance law,
in relation to the employee benefit fund for members of such unit; to
repeal certain provisions of the executive law and the state finance
law relating thereto; and making an appropriation therefor

5 Section 1. Paragraph a of subdivision 3 of section 216 of the execu-
6 tive law is REPEALED and a new paragraph a is added to read as follows:
7 a. Salary schedules for investigators, senior investigators, and
8 investigative specialists in the division of state police.
9 (1) Effective April first, two thousand twenty-three, members assigned
10 to the bureau of criminal investigation as investigators and investi-
11 gative specialists appointed to the bureau by the superintendent, shall
12 receive a basic annual salary pursuant to the following schedule:

27 (7) With respect to subparagraphs one, two, three, four, five and six
28 of this paragraph, members assigned to the bureau of criminal investi-
29 gation as investigators, investigative specialists and senior investi-
30 gators appointed to the bureau by the superintendent shall be paid a
31 basic annual salary consistent with their years of service in the bureau
32 and their principal place of employment, or, in the case of a field
33 employee, whose official station, as determined in accordance with the
34 regulations of the state comptroller, is located in the city of New York
35 or in the counties of Orange, Putnam, Dutchess, Rockland, Westchester,
36 Nassau, or Suffolk as depicted on the schedules contained in subpara-
37 graphs one, two, three, four, five and six of this paragraph.
38 (8) When any member assigned to the bureau of criminal investigation
39 completes a year of service entitling them to move to a higher salary,
40 they shall be paid the higher salary at the start of the pay period
41 immediately following their completion of the required years of service
42 in the bureau that move them to the next higher salary.
43 § 2. Paragraph b of subdivision 2 of section 207-b of the state
44 finance law is REPEALED and a new paragraph b is added to read as
45 follows:
46 b. Pursuant to the terms of an agreement negotiated between the execu-
47 tive branch of the state of New York and the employee organization
48 representing the collective negotiating unit consisting of investi-
49 gators, senior investigators, and investigative specialists in the divi-
50 sion of state police, and upon audit and warrant of the state comp-
51 troller, the director shall provide for the payment of monies to such
52 employee organization for the establishment and maintenance of an

1 employee benefit fund established by the employee organization for the
2 employees in the collective negotiating unit covered by the controlling
3 provisions of such agreement providing for such employee benefit fund,
4 such amount to be determined consistent with said agreement, including
5 any and all monies agreed to be transferred in said agreement, and on
6 the basis of the number of full-time annual salaried employees, other
7 than full-time seasonal employees, on the payroll for the payroll period
8 that includes March first, two thousand twenty-three, for payments to be
9 made on April first, two thousand twenty-three, and on the payroll for
10 the payroll period that includes March first, two thousand twenty-four,
11 for payments to be made on April first, two thousand twenty-four, and on
12 the payroll for the payroll period that includes March first, two thou-
13 sand twenty-five, for payments to be made on April first, two thousand
14 twenty-five. The amount, which will be determined pursuant to this
15 section, for employees who are paid from special or administrative
16 funds, other than the general fund or the capital projects fund of the
17 state, will be paid from the appropriations as provided by law, in which
18 case the state comptroller shall establish procedures to ensure repay-
19 ment from said special or administrative funds. The director shall enter
20 into an agreement with an employee organization, which sets forth the
21 specific terms and conditions for the transmittal of monies pursuant to
22 this section.
23 § 3. Subdivision 5 of section 216-b of the executive law is REPEALED
24 and a new subdivision 5 is added to read as follows:
25 5. (a) (1) Effective April first, two thousand twenty-three, all
26 members of the collective negotiating unit consisting of investigators,
27 senior investigators and investigative specialists in the division of
28 state police, who on their anniversary date of employment with the divi-
29 sion of state police have attained six or more years of such satisfac-
30 tory service in the division, shall be paid a longevity award according
31 to the following schedule for each year of such satisfactory service up
32 to twenty-five years:

37 (2) Effective April first, two thousand twenty-four, all members of
38 the collective negotiating unit consisting of investigators, senior
39 investigators and investigative specialists in the division of state
40 police, who on their anniversary date of employment with the division of
41 state police have attained six or more years of such satisfactory
42 service in the division, shall be paid a longevity award according to
43 the following schedule for each year of such satisfactory service up to
44 twenty-five years:

49 (3) Effective April first, two thousand twenty-five, all members of
50 the collective negotiating unit consisting of investigators, senior
51 investigators and investigative specialists in the division of state
52 police, who on their anniversary date of employment with the division of

1 state police have attained six or more years of such satisfactory
2 service in the division, shall be paid a longevity award according to
3 the following schedule for each year of such satisfactory service up to
4 twenty-five years:

9 (4) Individuals with greater than twenty-five years of service shall
10 continue to receive a longevity award at the twenty-five-year amount.
11 Such payment shall commence in the pay period following such anniversary
12 date and shall be annualized and paid over the year-long period between
13 anniversary dates.
14 (b) The longevity amounts provided by this subdivision shall be in
15 addition to, and shall not be a part of, a member's annual basic salary,
16 and shall not impair any increments or other rights or benefits to which
17 a member may be entitled; provided, however, that longevity awards shall
18 be included as compensation for purposes of computation of overtime pay
19 and for retirement purposes.
20 § 4. Subdivision 2 of section 216-c of the executive law is REPEALED
21 and a new subdivision 2 is added to read as follows:
22 2. In addition to the compensation provided in subdivision one of this
23 section, members of the collective negotiating unit consisting of inves-
24 tigators, senior investigators and investigative specialists in the
25 division of state police, on the payroll on November first of each year,
26 shall receive holiday compensation as follows:
27 April 1, 2023$1,835

30 Such payments shall be in addition to, and shall not be part of, the
31 member's annual basic salary, except for the purpose of retirement and,
32 effective May eighth, two thousand twenty-five, overtime, and shall be
33 made in a separate check during the payroll period which includes Decem-
34 ber first each year.
35 § 5. Health benefits committee. Pursuant to the terms of an agreement
36 negotiated between the executive branch of the state of New York and the
37 employee organization representing the collective negotiating unit
38 consisting of investigators, senior investigators, and investigative
39 specialists in the division of state police, during the period April 1,
40 2023 through March 31, 2026, there shall continue to be a committee on
41 health benefits funded in the following amounts:
42 April 1, 2023 - March 31, 2024 $6,095
43 April 1, 2024 - March 31, 2025 $6,278
44 April 1, 2025 - March 31, 2026 and beyond $6,466
45 One-half of this amount in each year shall be made available to the
46 state and one-half shall be made available to the employee organization
47 representing such unit.
48 § 6. Maintenance allowance. (a) Pursuant to the terms of an agreement
49 negotiated between the executive branch of the state of New York and the
50 employee organization representing the collective negotiating unit

1 consisting of investigators, senior investigators, and investigative
2 specialists in the division of state police, each member of such unit
3 shall receive a maintenance allowance as follows:
4 April 1, 2023 $3,779
5 April 1, 2024 $3,892
6 April 1, 2025 $4,009
7 (b) Such maintenance allowance shall be paid on an annualized basis in
8 regular bi-weekly paychecks. Such additional compensation, as provided
9 in this section, shall be in addition to, and shall not be part of, the
10 member's basic annual salary, and shall not affect or impair any rights
11 or benefits to which the member may be entitled; provided, however, that
12 such additional compensation shall be included as compensation for
13 purposes of computation of overtime pay and retirement.
14 § 7. Expertise pay. (a) Notwithstanding any other provision of law to
15 the contrary, pursuant to the terms of an agreement negotiated between
16 the executive branch of the state of New York and the employee organiza-
17 tion representing the collective negotiating unit consisting of investi-
18 gators, senior investigators, and investigative specialists in the divi-
19 sion of state police, members in such collective negotiating unit shall
20 receive expertise pay as follows:
21 April 1, 2023 $4,734
22 April 1, 2024 $5,109
23 April 1, 2025 $5,609
24 (b) Such expertise pay shall be payable to those unit members on the
25 payroll on November 1 of each year during the pay period that includes
26 December 1. Such additional compensation as provided in this section
27 shall be in addition to, and shall not be part of, the member's basic
28 annual salary, and shall not affect or impair any rights or benefits to
29 which the member may be entitled; provided, however, that such addi-
30 tional compensation shall be included as compensation for purposes of
31 computation of overtime pay and as compensation for retirement.
32 § 8. Professional development and training funds. Pursuant to the
33 terms of an agreement negotiated between the executive branch of the
34 state of New York and the employee organization representing the collec-
35 tive negotiating unit consisting of investigators, senior investigators,
36 and investigative specialists in the division of state police, during
37 the period April 1, 2023 through March 31, 2026, there shall continue to
38 be a professional development and quality of working life committee
39 funded in the following amounts from which the tuition reimbursement
40 program, the master's program, the employee assistance program and other
41 activities as outlined in the collective bargaining agreement shall be
42 supported:
43 April 1, 2023 to March 31, 2024 $99,829

46 § 9. Expanded duty pay. (a) Pursuant to the terms of an agreement
47 negotiated between the executive branch of the state of New York and the
48 employee organization representing the collective negotiating unit
49 consisting of investigators, senior investigators, and investigative
50 specialists in the division of state police, the annual payment for

1 expanded duty pay shall continue to be $9,235. Effective April 1, 2023,
2 this amount shall be $9,512. Effective April 1, 2024, the amount shall
3 be $9,797. Effective April 1, 2025, this amount shall be $11,860.
4 (b) Such expanded duty pay shall be annualized and paid during regular
5 bi-weekly periods. Such additional compensation as provided in this
6 section shall be in addition to, and shall not be part of, the member's
7 basic annual salary, and shall not affect or impair any rights or bene-
8 fits to which the member may be entitled; provided, however, that such
9 additional compensation shall be included as compensation for purposes
10 of computation of overtime pay and as compensation for retirement.
11 § 10. Supervisory responsibility pay. (a) Pursuant to the terms of an
12 agreement negotiated between the executive branch of the state of New
13 York and the employee organization representing the collective negotiat-
14 ing unit consisting of investigators, senior investigators, and investi-
15 gative specialists in the division of state police, effective March 31,
16 2005, certain members shall continue to receive additional compensation,
17 as prescribed in the interest arbitration award dated February 4, 2005
18 as modified by and contained within such agreement, when designated by
19 the division of state police to work as a "unit coordinator", "acting
20 senior investigator", or "acting administrative senior investigator".
21 (b) Such additional compensation as provided in this section shall be
22 in addition to, and shall not be part of, the member's basic annual
23 salary, and shall not affect or impair any rights or benefits to which
24 the member may be entitled; provided, however, that such additional
25 compensation shall be included as compensation for the purposes of
26 computation of overtime pay and retirement.
27 § 11. Location compensation. (a) Notwithstanding any other provision
28 of law to the contrary, members in the collective negotiating unit
29 consisting of investigators, senior investigators, and investigative
30 specialists in the division of state police whose principal place of
31 employment or, in the case of a field employee, whose official station,
32 as determined in accordance with the regulations of the state comp-
33 troller, is located in the county of Monroe, who were on the payroll on
34 March 31, 1985, and who have received this location compensation contin-
35 ually since then, shall continue to receive location pay at the rate of
36 $200 per year; provided that each such member continues to be otherwise
37 eligible.
38 (b) Pursuant to the terms of an agreement negotiated between the exec-
39 utive branch of the state of New York and the employee organization
40 representing the collective negotiating unit consisting of investi-
41 gators, senior investigators, and investigative specialists in the divi-
42 sion of state police, members of such unit whose principal place of
43 employment or, in the case of a field employee, whose official station,
44 as determined in accordance with the regulations of the state comp-
45 troller, is located in the city of New York or in the counties of Rock-
46 land, Westchester, Nassau, or Suffolk shall receive location pay effec-
47 tive April 1, 2023 in the amount of $1,807; $1,861 effective April 1,
48 2024 and $2,461 effective April 1, 2025. Notwithstanding any other
49 provision of law to the contrary, pursuant to the terms of the agreement
50 negotiated between the state and the employee organization representing
51 the collective negotiating unit consisting of investigators, senior
52 investigators, and investigative specialists in the division of state
53 police, members in this collective negotiating unit whose principal
54 place of employment, or, in the case of a field employee, whose official
55 station as determined in accordance with the regulations of the state
56 comptroller, is located in the county of Orange, Putnam or Dutchess

1 shall receive location pay at the rate of $1,807 effective April 1,
2 2023; $1,861 effective April 1, 2024 and $2,211 effective April 1, 2025.
3 (c) Such location pay as provided in this section shall be annualized
4 and paid during the regular bi-weekly periods. Such compensation shall
5 be in addition to and shall not be part of the member's basic annual
6 salary and shall not affect or impair any rights or benefits to which
7 the member may be entitled; provided, however, that location pay shall
8 be included as compensation for the purposes of computation of overtime
9 pay and retirement.
10 § 12. Supplemental location pay. (a) Pursuant to the terms of an
11 agreement negotiated between the executive branch of the state of New
12 York and the employee organization representing the collective negotiat-
13 ing unit consisting of investigators, senior investigators, and investi-
14 gative specialists in the division of state police, members of such unit
15 whose principal place of employment, or, in the case of a field employ-
16 ee, whose official station, as determined in accordance with the regu-
17 lations of the state comptroller, is located in the city of New York or
18 in the county of Putnam, Orange, Dutchess, Rockland, Westchester,
19 Nassau, or Suffolk shall continue to receive supplemental location pay,
20 in addition to the location pay provided in section eleven of this act,
21 as follows:

28 (b) Such supplemental location pay shall be annualized and paid during
29 the regular bi-weekly periods. Such compensation shall be in addition to
30 and shall not be part of the member's basic annual salary and shall not
31 affect or impair any rights or benefits to which the member may be enti-
32 tled; provided, however, that supplemental location pay shall be
33 included as compensation for the purposes of computation of overtime pay
34 and retirement.
35 § 13. (a) Notwithstanding any other provision of law to the contrary,
36 pursuant to the terms of an agreement negotiated between the executive
37 branch of the state of New York and the employee organization represent-
38 ing the collective negotiating unit consisting of investigators, senior
39 investigators, and investigative specialists in the division of state
40 police, members in such collective negotiating unit shall, upon reaching
41 eight years of service in the division, continue to receive seniority
42 pay as of April 1, 2023 at the rate of $1519. However, effective May 8,
43 2025, unit members shall receive seniority pay when such individual
44 reaches eight or more years with the New York state police, holds the
45 rank of sergeant, or takes the sergeant's exam and is placed on the
46 sergeant's list for promotion.
47 (b) Such seniority pay shall be annualized and paid during the regular
48 bi-weekly periods. Such compensation shall be in addition to and shall
49 not be part of the member's basic annual salary and shall not affect or
50 impair any rights or benefits to which the member may be entitled;
51 provided, however, that seniority pay shall be included as compensation
52 for the purposes of computation of overtime pay and retirement.
53 § 14. Unused sick leave at retirement. Pursuant to the terms of an
54 agreement negotiated between the executive branch of the state of New

1 York and the employee organization representing the collective negotiat-
2 ing unit consisting of investigators, senior investigators, and investi-
3 gative specialists in the division of state police, members of such unit
4 shall continue to receive a lump sum cash payment for accumulated and
5 unused sick leave credits standing to the employee's credit at the time
6 of separation from service by retirement. The amount of such payment
7 shall be determined in the following manner:
8 (a) Effective April 1, 1998, the number of days of such accumulated
9 and unused sick leave, not to exceed 300 days, less 165 days, shall be
10 multiplied by the member's daily rate of pay in effect at the time of
11 separation from service by retirement.
12 (b) The lump sum payment shall be one-fifth of such amount provided
13 for in subdivision (a) of this section.
14 (c) Such additional compensation shall be in addition to and shall not
15 be part of the member's basic annual salary and shall not affect or
16 impair any rights or benefits to which the member may be entitled;
17 provided, however, that such additional compensation shall be included
18 as compensation for retirement purposes.
19 § 15. Lump sum payment. Each eligible member of this unit shall
20 receive a one-time lump sum payment in the amount of $3,000. This
21 payment is not part of basic annual salary, is not subject to any salary
22 increases and is not pensionable. The one-time lump sum payment shall be
23 pro-rated for those employees paid on any basis other than an annual
24 basis. To qualify, employees must be in continuous service in the unit
25 between the period September 26, 2024 through July 25, 2025. Employees
26 who leave state service between September 26, 2024 through July 25,
27 2025, are not eligible for this bonus unless they retire directly from
28 active state employment. This bonus shall be effective July 25, 2025. If
29 a member received a lump sum payment as a member of another state
30 bargaining unit, they shall not receive a second lump sum payment.
31 § 16. Recognized degree pay. (a) Pursuant to the terms of an agreement
32 negotiated between the executive branch of the state of New York and the
33 employee organization representing the collective negotiating unit
34 consisting of investigators, senior investigators, and investigative
35 specialists in the division of state police, members of such unit who
36 possess or obtain a recognized degree from an accredited and recognized
37 college or university on or after April 1, 2001, shall continue to
38 receive a lump sum payment of $250 for an associate degree, $500 for a
39 bachelor's degree, and $750 for a graduate degree. Payment for such
40 degree shall occur annually in June of each year and shall be for one
41 degree only. When such degree is obtained in a fiscal year, such
42 payment shall be made as soon as practicable after conferral of the
43 degree.
44 (b) Such additional compensation as provided in this section shall be
45 in addition to, and shall not be part of, the member's basic annual
46 salary, and shall not affect or impair any rights or benefits to which
47 the member may be entitled; provided, however, that such additional
48 compensation shall be included as compensation for retirement purposes.
49 § 17. Short swings. Notwithstanding any provision of law to the
50 contrary, pursuant to the terms of an agreement negotiated between the
51 executive branch of the state of New York and the employee organization
52 representing the collective negotiating unit consisting of investi-
53 gators, senior investigators, and investigative specialists in the divi-
54 sion of state police, effective September 1, 2016, members of this unit
55 who are required to work short swings shall receive compensation of
56 thirty dollars ($30) for each short swing they are required to work and

1 actually work. There shall be no short swing compensation where the
2 short swing is worked at the request of, or for the convenience of the
3 member, as determined by the division of state police. The definition
4 of short swing shall be when there are eight hours or less between the
5 scheduled end time of a member's tour of duty and the start time of the
6 next scheduled tour of duty. Such compensation shall not be payable if
7 such member's hours of work continue from the end time of the member's
8 tour of duty to the commencement of the start time of the next scheduled
9 tour of duty without interruption.
10 § 18. Notwithstanding any provision of law to the contrary, pursuant
11 to the terms of an agreement negotiated between the executive branch of
12 the state of New York and the employee organization representing the
13 collective negotiating unit consisting of investigators, senior investi-
14 gators, and investigative specialists in the division of state police,
15 members of such unit shall receive recall overtime only in accordance
16 with the terms of the collective bargaining agreement.
17 § 19. Payment and publication of grievance arbitration settlements and
18 awards. Notwithstanding any provision of law to the contrary, the
19 appropriations contained in this act shall be available to the state for
20 the payment and publication of grievance arbitration settlements and
21 awards pursuant to article 15 of the collective negotiating agreement
22 between the state and the employee organization representing the collec-
23 tive negotiating unit consisting of investigators, senior investigators,
24 and investigative specialists in the division of state police, such
25 provisions being in effect pursuant to paragraph (e) of subdivision 1 of
26 section 209-a of the civil service law.
27 § 20. The compensation and benefit modifications provided for by this
28 act for state employees in the collective negotiating unit consisting of
29 investigators, senior investigators, and investigative specialists in
30 the division of state police pursuant to article 14 of the civil service
31 law shall not be implemented until the director of employee relations
32 shall have delivered to the director of the budget and the comptroller a
33 letter certifying that there is in effect with respect to such negotiat-
34 ing unit a collective bargaining agreement which provides for such
35 compensation and benefit modifications and which is fully executed in
36 writing with the state pursuant to article 14 of the civil service law,
37 and ratified pursuant to the ratification procedure of the employee
38 organization certified pursuant to article 14 of the civil service law
39 to represent such collective negotiating unit.
40 § 21. Date of entitlement to salary increase. Notwithstanding the
41 provisions of this act or of any other provision of law to the contrary,
42 the increase of salary or compensation of any member of the collective
43 negotiating unit consisting of investigators, senior investigators, and
44 investigative specialists in the division of state police provided by
45 this act shall be added to the salary of such member at the beginning of
46 that payroll period the first day of which is nearest to the effective
47 date of such increase as provided in this act, or at the beginning of
48 the earlier of two payroll periods the first days of which are nearest
49 but equally near to the effective date of such increase as provided in
50 this act; provided, however, that, for the purposes of determining the
51 salary of such officer or employee upon reclassification, reallocation,
52 appointment, promotion, transfer, demotion, reinstatement, or other
53 change of status, such salary increase shall be deemed to be effective
54 on the date thereof as prescribed by this act, with payment thereof
55 pursuant to this section on a date prior thereto, instead of on such
56 effective date, and shall not operate to confer any additional salary

1 rights or benefits on such officer or employee. Payment of such salary
2 increase may be deferred pursuant to section twenty-two of this act.
3 § 22. Deferred payment of salary increase. Notwithstanding the
4 provisions of any other section of this act or of any other provision of
5 law to the contrary, pending payment pursuant to this act of the basic
6 annual salaries of incumbents of positions subject to this act, such
7 incumbents shall receive, as partial compensation for services rendered,
8 the rate of compensation otherwise payable in their respective posi-
9 tions. An incumbent holding a position subject to this act at any time
10 during the period from the effective dates of the salary increases
11 provided for in this act until the time when basic annual salaries are
12 first paid pursuant to this act for such services in excess of the
13 compensation actually received therefor, shall be entitled to a lump sum
14 payment for the difference between the salary to which such incumbent is
15 entitled for such service and the compensation actually received there-
16 for. Such lump sum payment shall be made as soon as practicable. Any
17 amount payable in such lump sum paid represents compensation earned in
18 each of the year or years for which it is calculated pursuant to this
19 act and not as compensation earned wholly in the year during which the
20 lump sum is paid. Notwithstanding any law, rule or regulation to the
21 contrary, no member of the unit consisting of investigators, senior
22 investigators, and investigative specialists in the division of state
23 police to whom the provisions of this act apply shall be entitled to, or
24 owed, any interest or other penalty for any reason on any monies due to
25 such member pursuant to the terms of the agreement covering employees in
26 the unit consisting of investigators, senior investigators, and investi-
27 gative specialists in the division of state police.
28 § 23. Use of appropriations. Notwithstanding any provision of the
29 state finance law or any other provision of law to the contrary,
30 commencing April 1, 2025, the state comptroller is authorized to pay any
31 amounts required by the provisions of this act to any state department
32 or agency from any appropriation or other funds available to such state
33 department or agency for personal service, other than personal service
34 and fringe benefits. To the extent that such appropriations are insuffi-
35 cient in any fund to accomplish the purposes herein set forth, the
36 director of the budget is authorized to allocate to the various depart-
37 ments and agencies, from any appropriations available in any fund, the
38 amounts necessary to pay such amounts. The aforementioned appropriations
39 shall be available for payment of any liabilities or obligations
40 incurred during the period April 1, 2023 to March 31, 2026.
41 § 24. Notwithstanding any provision of the state finance law or any
42 other provision of law to the contrary, the sum of $43,700,000 is hereby
43 appropriated in the general fund/state purposes account (10050) in
44 miscellaneous-all state departments and agencies solely for
45 apportionment/transfer by the director of the budget for use by any
46 state department or agency in any fund during the period April 1, 2023
47 through March 31, 2026 to supplement appropriations for personal
48 service, other than personal service and fringe benefits, and to carry
49 out the provisions of this act. No money shall be available for expendi-
50 ture from this appropriation until a certificate of approval has been
51 issued by the director of the budget and a copy of such certificate or
52 any amendment thereto has been filed with the state comptroller, the
53 chair of the senate finance committee and the chair of the assembly ways
54 and means committee. The monies hereby appropriated are available for
55 payment of any liabilities or obligations incurred during the period
56 April 1, 2023 through March 31, 2026. For this purpose, the monies

1 appropriated shall remain in full force and effect for the payment of
2 liabilities incurred on or before March 31, 2026.
3 § 25. Notwithstanding any provision of law to the contrary, the
4 several amounts as hereinafter set forth, or so much thereof as may be
5 necessary, are hereby appropriated from the fund so designated for use
6 by any state department or agency during the period April 1, 2023
7 through March 31, 2026 to supplement appropriations from each respective
8 fund available for other than personal service and fringe benefits, and
9 to carry out the provisions of this act. The monies hereby appropriated
10 are available for the payment of any liabilities or obligations incurred
11 during the period April 1, 2023 through March 31, 2026. No money shall
12 be available for expenditure from the monies appropriated until a
13 certificate of approval has been issued by the director of the budget
14 and a copy of such certificate or any amendment thereto has been filed
15 with the state comptroller, the chair of the senate finance committee
16 and the chair of the assembly ways and means committee.

26 § 26. This act shall take effect immediately; provided that the direc-
27 tor of employee relations certifies that there is in effect with respect
28 to the negotiating unit consisting of investigators, senior investi-
29 gators, and investigative specialists in the division of state police a
30 collective bargaining agreement which provides for the compensation and
31 benefit modifications in this act and shall be deemed to have been in
32 full force and effect on and after April 1, 2023; provided that the
33 secretary of state shall notify the legislative bill drafting commission
34 upon the occurrence of the certification by the director of employee
35 relations that such collective bargaining agreement is in effect in
36 order that the commission may maintain an accurate and timely effective
37 data base of the official text of the laws of the state of New York in
38 furtherance of effectuating the provisions of section 44 of the legisla-
39 tive law and section 70-b of the public officers law. Appropriations
40 made by this act shall remain in full force and effect for liabilities
41 incurred through March 31, 2026.

REPEAL NOTE. -- Paragraph a of subdivision 3 of section 216 of the
executive law, repealed by section one of this act, provided salary
schedules for state employees in particular titles in the collective
negotiating unit consisting of investigators, senior investigators,
investigative specialists in the division of state police and is
replaced by revised salary schedules in a new paragraph a of such subdi-

vision 3 implementing an agreement pursuant to article 14 of the civil
service law.
Paragraph b of subdivision 2 of section 207-b of the state finance
law, repealed by section two of this act, provided for payments to an
employee benefit fund for state employees in the particular titles in
the collective negotiating unit consisting of investigators, senior
investigators and investigative specialists in the division of state
police and is replaced by revised schedule of payments to be made to
such fund in a new paragraph b of such subdivision 2 implementing an
agreement pursuant to article 14 of the civil service law.
Subdivision 5 of section 216-b of the executive law, repealed by
section three of this act, provided for longevity payments to eligible
members of the collective negotiating unit consisting of investigators,
senior investigators and investigative specialists in the division of
state police and is replaced by revised longevity payment amounts in a
new subdivision 5 of such section implementing an agreement pursuant to
article 14 of the civil service law.
Subdivision 2 of section 216-c of the executive law, repealed by
section four of this act, provided for holiday compensation payments
based on four days' pay to eligible members of the collective negotiat-
ing unit consisting of investigators, senior investigators and investi-
gative specialists in the division of state police and is replaced by a
revised payment amount in a new subdivision 2 of such section implement-
ing an agreement pursuant to article 14 of the civil service law.
