AN ACT to amend the public health law, in relation to certain services
provided by source plasma donation centers
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subdivisions 2 and 2-b of section 571 of the public health
2 law, subdivision 2 as amended by chapter 436 of the laws of 1993 and
3 subdivision 2-b as added by a chapter of the laws of 2021 amending the
4 public health law relating to source plasma donation centers, as
5 proposed in legislative bills numbers S. 2119 and A. 228, are amended to
6 read as follows:
7 2. "Blood bank" means a facility for the collection, processing, stor-
8 age and/or distribution of human blood, blood components or blood deriv-
9 atives, but shall not mean a source plasma donation center.
10 2-b. "Plasmapheresis" means a procedure [in] by which, during a single
11 visit to the facility, blood is removed from an individual, the source
12 plasma separated from the formed elements, and at least the red blood
13 cells are returned to the donor.
14 § 2. Subdivision 1 of section 575-a of the public health law, as added
15 by a chapter of the laws of 2021 amending the public health law relating
16 to source plasma donation centers, as proposed in legislative bills
17 numbers S. 2119 and A. 228, is amended to read as follows:
18 1. [A] Notwithstanding section five hundred seventy-four and subdivi-
19 sion one of section five hundred seventy-one of this chapter, a source
20 plasma donation center may collect source plasma through plasmapheresis,
21 and may employ a person to perform total protein tests using digital
22 refractometers, and to perform hematocrit tests, if the source plasma
23 donation center and such person comply with all the requirements of
24 federal law and regulations governing the collection of source plasma,
25 including, but not limited to, laws governing staff supervision, train-
26 ing, and duties, including requirements for performing total protein
27 tests using digital refractometers in a source plasma donation center.

1 § 3. This act shall take effect on the same date and in the same
2 manner as a chapter of the laws of 2021 amending the public health law
3 relating to source plasma donation centers, as proposed in legislative
4 bills numbers S. 2119 and A. 228, takes effect.
