AN ACT in relation to establishing a toll-free overnight hours pilot
program on the New York state thruway; and providing for the repeal of
such provisions upon expiration thereof
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. 1. No later than 120 days after the effective date of this
2 act, the New York state thruway authority shall establish and administer
3 a toll-free overnight hours pilot program to reduce congestion during
4 daytime peak hours by incentivizing off-peak travel, provide cost
5 savings to New York residents, truckers, and businesses relying on
6 freight transportation, support smoother traffic flow and decrease wear-
7 and-tear on roads by redistributing vehicle usage, and promote environ-
8 mental benefits by reducing vehicle idling and improving air quality
9 during peak hours. Under such program, tolls on the New York state thru-
10 way shall be eliminated for E-ZPass users between the hours of 10 PM and
11 6 AM. The authority shall collect and analyze data on traffic patterns,
12 toll revenue, and public feedback for the duration of such program.
13 2. No later than 90 days after the completion of such program, the New
14 York state authority shall submit a report to the governor, the tempo-
15 rary president of the senate and the speaker of the assembly containing
16 the findings of such pilot program and any recommendations for legisla-
17 tive action.
18 § 2. This act shall take effect immediately and shall expire and be
19 deemed repealed two years after the submission of the report required
20 pursuant to section two of this act; provided, however, that the New
21 York state thruway authority shall notify the legislative bill drafting
22 commission upon the occurrence of the enactment of the legislation
23 provided for in section one of this act in order that the commission may
24 maintain an accurate and timely effective data base of the official text
25 of the laws of the state of New York in furtherance of effectuating the
26 provisions of section 44 of the legislative law and section 70-b of the
27 public officers law.
