        AN  ACT  to  amend  the  general municipal law, in relation to requiring
          municipal corporations to  reimburse  residents  for  the  justifiable
          maintenance of publicly owned areas

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. The general municipal  law  is  amended  by  adding  a  new
     2  section 137 to read as follows:
     3    §  137. Justifiable maintenance of publicly owned areas. Every munici-
     4  pal corporation located within the state shall establish a reimbursement
     5  program for resident maintenance expenses associated with publicly owned
     6  sidewalks, curbs and adjacent landscaped areas.  For  purposes  of  this
     7  section,  maintenance  shall include snow removal, the removal of debris
     8  and any other upkeep deemed justifiable  maintenance  by  the  municipal
     9  corporation.  A comprehensive list of such justifiable maintenance shall
    10  be provided to each resident. Each municipal corporation shall establish
    11  a mechanism for residents to provide documentation of justifiable  main-
    12  tenance  expenses.  After  such documentation is received, the municipal
    13  corporation shall reimburse such residents in whole or in part  for  all
    14  established justifiable maintenance.
    15    §  2.  This  act shall take effect on the ninetieth day after it shall
    16  have become a law.
